COMMENTARY


RCMP members negligently discharged their service weapons 21 times in 2007 according to the response to an Access to Information Request received by firearm researcher Dennis Young. [i]

Those 21 negligent discharges account for 37% of all RCMP's member-involved shootings.

This is both good and bad news.

It’s good news because RCMP members don’t feel the need to discharge their police-issued weapons very often.

It’s bad news because for every three times an RCMP member fires his or her weapon, one of those times was unintentional.

Worse, 20 of the RCMP’s 21 negligent discharges (95%) occurred in conditions identified in the ATIP response as “Low Stress”.

The ATIP response explanations of events surrounding each of these cases are:

  • Routine Firearm Task: Completing safety and mechanical check
  • Routine Firearm Task: Completing pre-patrol firearm inspection
  • Routine Firearm Task: Unloading firearm after shift
  • Routine Firearm Task: Unloading firearm after operational skills training
  • Routine Firearm Task: Loading firearm for duty
  • Routine Firearm Task: Completing disassembly of firearm for cleaning
  • Routine Firearm Task: Accidently “grazed” trigger while slung with safety off
  • Muscle Co-Activation: While engaging the safety after firing
  • Startle Response: Distraction device was utilized and the second “bang” was heard

The RCMP classifies negligent discharge of a firearm (when a gun is discharged without intent to do so) as “unintentional”. Lack of intention means lack of paying proper attention, as the descriptions above show, which is the definition of negligence.

Basic firearm safety tells us to keep your finger off the trigger until you can positively identify your target, know what is beyond your target, and are ready to shoot at your target.

Only then do you place your finger on the bang switch. When a firearm is discharged outside of those conditions, it is due to negligence.

Firearms have the ability to provide great safety and security (this is why police carry them) or to cause grave injury or death when used negligently.

Thankfully in these cases, at least as far as the ATIP Response indicates, nobody was injured or killed.

For this we can all be grateful. We would like to see better training instituted for RCMP members so the 95% of wholly preventable negligent discharges is zero.

Politicians are experts at ignoring information that makes them uncomfortable.

The fact gang and gun violence in Toronto has skyrocketed since police were banned from doing street cheeks makes them uncomfortable, lest they be accused of racism by anti-police activists if they acknowledge it.

And so at City Hall and Queen’s Park they ignore reality, saying they’re hiring more police officers, implementing new shift schedules to more effectively deploy the force and investing more money in policing and programs to address the root causes of violence.

Despite that, since street checks were banned in 2014, the number of shootings compared to 2019 is up by 178%, victims by 218% and shooting homicides by 63%.
New Liberal gun measures stack up as Bill C-71 amendments wait for cabinet orders

Two dozen Firearms Act amendments from legislation Parliament passed last year, including tougher background checks for licence eligibility and validation before sales, won’t be in place until sometime after the spring budget, Public Safety Minister Bill Blair says.

“That’s work ongoing, but it’s regulatory and so there are some budget issues that will be addressed in the coming budget and then regulations will be brought forward to bring into effect all of the measures that were approved in that bill,” Blair told iPolitics Wednesday.

And, with even more new gun control measures in the works, Blair said he has not yet set a deadline to complete another measure stemming from the 2019 bill — a reversal of a 2015 Conservative decision to overrule RCMP classifications that prohibited certain models of military grade rifles imported and sold in Canada.

Police presence expected at P.E.I. schools after weapons threat

HALIFAX -- Police will be present at Prince Edward Island schools after an anonymous tip suggested someone might bring a gun to school.

Police and government officials talked about the investigation during a news conference on Sunday.

They said the tip came in late Friday afternoon and that the alleged threat wasn’t directed at a specific school or person.

“Law enforcement received an anonymous tip suggesting an unknown person would bring a firearm to a school,” explained Bethany MacLeod, the deputy minister of education and lifelong learning, during Sunday’s news conference, which was live streamed on Facebook.

“An extensive investigation involving all police agencies in the province, and in consultation with school officials, failed to turn up any information that would suggest that this threat was credible.”

GTA MP tabling bill raising mandatory prison time
for owning a smuggled gun

A Conservative MP representing a riding in the Greater Toronto Area will use his high-ranking spot in the queue for non-cabinet ministers to push through legislation in the House to introduce a bill that would increase the length of prison sentences for possessing a gun that was smuggled into Canada.

At the moment in Canada , if someone is found guilty of possessing any prohibited firearms – whether it be one that was illegally obtained or is restricted – they are subject to a minimum punishment of one year in prison.

Markham-Unionville MP Bob Saroya is introducing legislation that would amend the criminal code to increase the mandatory sentence to three years for someone found in possession of a gun illegally brought into Canada. If an offender were found guilty of owning a smuggled gun a second time, their prison sentence would be a minimum of five years. The proposed new penalties are equal to the mandatory sentences for illegally importing or exporting firearms.

GUYSBOROUGH, N.S. — Lionel Desmond wouldn’t have had a valid licence to buy the rifle he used to kill his family if the New Brunswick Firearms Office had been aware of the extent of his interactions with mental health care providers and the RCMP.

That's what the Desmond fatality inquiry heard from the operations manager for the provincial firearms office Thursday after Judge Warren Zimmer read her a letter signed by doctors at a Fredericton occupational stress injury clinic recommending an inpatient facility in Quebec take Desmond as a client due to his severe post-traumatic stress disorder and depression, amongst other issues.

"I've even heard from many people, who don't even own firearms Madame Speaker, but they are concerned that there is over reach. This government's blanket ban and confiscation of firearms from everyday Canadians will not be beneficial," he said.

Melillo says he wants the federal government to clearly define the term "military style assault rifle" as he believed the proposed legislation is too vague.

The official petition against the proposed gun ban is the most signed petition in Canadian history, with over 175,000 signatures as of the time of writing. There is currently no timeline on when the ban would be put into place.

Op-Ed: Liberal Gun Laws Unfairly Target Law Abiding Firearms Owners

Criminals should not have guns. Nor should there be any tolerance or leniency on people committing violent gun offenses. All Canadians can agree on that.

Smart gun laws should target bad guys in organized crime and other criminals using blatantly illegal firearms.

Once again, Trudeau's Liberals are preying on the innocent law abiders and avoiding the tough work of taking on gangs and crime. Liberal measures like Bill C-71 and their proposed municipal handgun ban are sending bureaucratic buckshot at more than two million Canadians who, like me, own firearms and are law-abiding, registered sport shooters, farmers and hunters.

Bill C-71 simply imposes more administrative red tape that is a waste of time and money, but more importantly, serves no safety purpose. The proposed Trudeau municipal handgun ban, invented as a photo op in the middle of an election campaign, is widely dismissed as ineffective and costly, by none other than the Canadian Association of Chiefs of Police. Even the Public Safety Canada website says, "The vast majority of owners of handguns and other firearms in Canada lawfully abide by the requirements, and most gun crimes are not committed with legally owned firearms."

‘Illegal firearms are a plague:’ Toronto businessman
gets 5 years for illegal gun sale

A successful businessman with an otherwise unblemished record has been jailed for five years for illegally selling and possessing guns in a case that left the judge scratching his head.

In a strongly worded sentencing decision, Superior Court Justice Robert Goldstein said a conditional sentence for Antonio Sampogna would send the wrong message about fairness in the justice system.

All too often, the judge said, it is young men of colour who face gun-related charges. Those accused, he said, are frequently from marginalized backgrounds and have faced significant obstacles in their lives. Sampogna bears little resemblance to them, Goldstein said.

Sanctuary Cities For Guns? This Utah County Is Trying It Out.

A county in Utah has shot down the idea of more gun control by becoming the first county in the state to declare itself a Second Amendment sanctuary.
 
The three-member Uintah County Commission voted unanimously to pass an  ordinance  making the county a stronghold that refuses to comply with federal or state laws on firearms that county leaders deem unconstitutional. 

The ordinance, Uintah County Commissioner Bill Stringer told The Daily Signal, is in preparation for anticipated unconstitutional legislation restricting gun sales and ownership at the state level.

I have a tremendous amount of personal experience with the M14 rifle. I first handled one and saw it demonstrated at Camp Perry, Ohio, when I was only 13. I lived with one in my room for four years as a cadet at West Point. I qualified with it, drilled with it, paraded with it, competed with it, trained with it and trained cadets in following classes how to shoot it.

While I was a cadet at West Point, the M16 was entering U. S. military service in large numbers, particularly in Vietnam. I became a fan of the M16, but it was clear even then that the M16 had a number of performance limitations compared to the M14. The Army took the “one or the other but not both” approach, and within a few years, the M14 was completely replaced by the M16A1 as the standard U. S. Army service rifle.

Germany reopens hate speech, gun law debates after shisha bar killings

BERLIN (Reuters) - Germany faced calls to toughen gun ownership laws and step up efforts to track far-right sympathizers after the suspect in one of its worst mass shootings since World War Two was found to have published a racist manifesto.

The 43-year-old presumed killer of nine people in two shisha bars in the southwestern town of Hanau late on Wednesday had posted the document, espousing conspiracy theories and deeply racist views, online.

The suspect, who is believed to have killed himself and his mother after the shootings, belonged to a gun club, raising questions as to how a man with such ideological convictions managed to gain membership and obtain the weapons he used.

Bill allowing carry of guns into Georgia sails through House panel

A Georgia House panel on Wednesday approved legislation that aims to allow anyone to bring their firearm into Georgia if he or she has a permit to carry a weapon.

Georgia currently operates under what is known as “reciprocity” — where only people from states that allow those with Georgia gun permits to carry the weapons there can bring their guns here. Georgia has the “reciprocity” agreements with 32 states ranging from South Carolina to Wyoming.

The proposal unanimously cleared a House Public Safety subcommittee.

House Bill 787 , sponsored by  Canton Republican Rep. Mandi Ballinger , said the purpose of the legislation is to make it easier for travelers to bring their guns into the state.

Air pistol shooter Allan Harding of Gibsons helped Team Canada reach ninth place at InterShoot 2020, an annual international air pistol and rifle shooting competition in The Hague, Netherlands. The tournament started Feb. 6 and lasted three days. In the team event, Harding competed with Stuart Burns and Robert Katz to finish ninth out of 10 teams.

“Being 9th out of 10 was a bit of a disappointment for Team Canada,” Harding said. “Each of us on our team had one good day and team aggregate scoring was only done from day two so we placed lower on the leaderboard that day. We still did well when we look at the scores but we know we also could have done a lot better.”

Sudbury letters: Gun plan not based on evidence

In response to demands from the Liberal base, Public Safety Minister Bill Blair has announced he will soon move to ban and confiscate certain firearms in Canada. This will entail vast amounts of time, effort and public money; all for the greater good, of course.

However, the problem is the Liberal plan is not based on any credible evidence, but is a surrender to the demands of an implacable group of supporters who wish to see Canadians stripped of all firearms, save for the government.

Justin Trudeau has always had much to say about how his government would make decisions and set policies based on sound evidence. However, on the firearms file, the government has exactly zero evidence to support its decision to ban and confiscate. What it does have is the emotion-based demands of the gun control crowd. The Liberals have conducted no scientifically sound research or studies into the problem they wish to fix. In fact, the only hard data they have is their own online public consultation, which overwhelmingly showed no support (80 per cent of respondents) to move ahead with further bans and confiscations.

Extension to Bows
Your coverage now extends to bows, including crossbows, recurve, compound and longbows.
 
You are not required to disclose any information about firearms in your possession.
 
Firearm Legal Defence insurance covers:
  • Defence from prosecution should you be charged with an offence arising out of the use, storage, display, transportation or handling of a firearm;
  • Cases where a firearm is used in self defence, the defence of a person under your protection or the defence of your property;
  • Appealing an event where a licensing, regulatory or judicial authority refuses to renew, suspends, revokes, cancels or alters the terms of your firearms license. Note that this provision does not apply to new license applications.
 
Firearm Legal Defence pays for:
  • The cost of retaining a lawyer or other appointed representative, including court fees, experts’ fees, police reports and medical reports;
  • Costs awarded by the court to opponents in civil cases if the insured person has been ordered to pay them, or pays them with the agreement of the insurance company;
  • Lost salary or wages for the time the insured is off work to attend court or any other hearing at the request of the appointed representative, up to a maximum of $500 per day and $10,000 in total.
