INCOMPAS Congratulates Rosenworcel on Confirmation
Last week, the Senate confirmed Jessica Rosenworcel as the first permanent chairwoman of the FCC.

INCOMPAS Weighs In On New Robocall Mitigation
Requirements for Gateway Providers
INCOMPAS last week filed comments in the proceeding proposing new requirements for gateway providers in order to mitigate foreign-originated illegal robocalls. The association urged the FCC to apply call authentication and robocall mitigation obligations to voice service providers in a neutral and symmetric manner.

"While the item proposes several necessary changes, such as gateway providers’ implementation of STIR/SHAKEN and caller ID authentication solutions, it also proposes several robocall mitigation requirements that may unnecessarily burden gateway providers that, if the order is adopted, will already be subject to the obligations imposed on intermediate providers," INCOMPAS said in its comments.

INCOMPAS also offered comment on some unintended consequences of its proposal to mandate gateway providers to block calls that are highly likely to be illegal.
NTIA Broadband Grant Program Listening Session Set for Dec. 15
NTIA will host broadband grant program public virtual listening sessions in connection with the five new broadband grant programs authorized and funded by the Infrastructure Investment and Jobs Act: The Broadband Equity, Access, and Deployment Program; the Enabling Middle Mile Broadband Infrastructure Program; and the Digital Equity Act Programs, which include the State Digital Equity Planning Grant Program, State Digital Equity Capacity Grant Program, and Digital Equity Competitive Grant Program.

These public virtual listening sessions are designed to collect stakeholder input to help inform program development and implementation.

FCC Issues Agenda for December 14 Open Meeting
The FCC issued the Sunshine Notice for its Decembers 14 open meeting where it will consider:

  • Improving Accessibility and Clarity of Emergency Alerts – An NPRM and NOI to improve clarity and accessibility of Emergency Alert System (EAS) visual messages to the public, including for persons who are deaf or hard of hearing, and others who are unable to access the audio message.
  • Facilitating Satellite Broadband Competition – An Order and NPRM that would propose revisions to the Commission’s rules for spectrum sharing among low-earth orbit satellite systems. The goal of the proposed revisions is to facilitate the deployment of the new generation of non-geostationary satellite orbit, fixed satellite service (NGSO FSS) systems, including new competitors.
  • Promoting Fair and Open Competitive Bidding in the E-Rate Program – An NPRM that proposes to implement a central document repository (i.e, bidding portal) through which service providers would be required to submit their bids to the E-Rate Program Administrator and seeks comment on other changes to the E-Rate competitive bidding rules.

The FCC also published dates for 2022 Open Meetings.
Wireline Bureau Waves EBB Program Rules, Provides
Guidance on Transition to Affordable Connectivity Program
The Wireline Competition Bureau issued an order on December 8 waiving certain provisions of Sections 54.1600(n), (s) and 54.1601(c)(2) that govern the internet service offering, standard rate, provider participation and election notice requirements for the end of the Emergency Broadband Benefit (EBB) Program as a result of the Infrastructure Investment and Jobs Act. The bureau also provided additional guidance to help consumers, participating service providers, program partners and other stakeholders prepare for the transition from the EBB Program to the Affordable Connectivity Program.
NTIA Propose Services Areas for Broadband Infrastructure Program
The National Telecommunications and Information Administration (NTIA) published proposed service areas for two applications undergoing review for funding through the NTIA Broadband Infrastructure Program. The proposed service areas for these two applications were provided by the applicants before the program’s 90-day application window closed on August 17, 2021, but were omitted in error from NTIA’s first announcement on October 4, 2021.

Broadband service providers are invited to submit information about any services offered in the proposed service areas listed in the link above within 15 calendar days. The announcement of proposed service areas will assist NTIA in targeting federal funds appropriately to areas lacking qualifying broadband service. NTIA will consider the information submitted by service providers as a factor in its evaluation of the program’s applications.
Sens. Thune, Markey Introduce Robocalls Bill
Sens. John Thune (R-S.D.) and Ed Markey (D-Mass.) introduced the Robocall Trace Back Enhancement Act on Dec. 8, 2021, to help bolster privately led efforts to trace back the origins of illegal robocalls.
