Executive Order Establishes Federal AI Regulation Framework

On December 11, President Trump signed a broad Executive Order – Ensuring a National Policy Framework for Artificial Intelligence – aimed at curbing state and local AI regulations that the administration views as inconsistent with a unified federal approach to support U.S. AI competitiveness and innovation. The Order:

  • Directs the Department of Commerce to evaluate existing state AI laws and identify those deemed “onerous” or conflicting with federal policy
  • Empowers the Attorney General to establish an AI Litigation Task Force to challenge state laws in court
  • Authorizes federal agencies to consider withholding discretionary funding – including broadband programs – from states whose AI rules the administration finds problematic.
  • Directs the Commerce Department to assess the use of BEAD non-deployment funds as potential leverage, signaling that states with restrictive or divergent AI laws could face heightened scrutiny of their non-deployment funds or future funding limitations.
  • Calls on the FCC and FTC to explore preemptive federal standards
  • Positions the White House to prepare legislative recommendations for a uniform national AI framework, asserting that fragmented state regulation could hinder economic and national security objectives.

INCOMPAS Welcomes AWS's Olivia Igbokwe-Curry to Board

INCOMPAS is pleased to welcome Olivia Igbokwe-Curry, director of U.S. Federal Affairs & Public Policy at Amazon Web Services to its board of directors.

Igbokwe-Curry has been with AWS for over six years, serving in her current role for nearly four years. Prior to that, she worked in government affairs for Conduent, Xerox, Four Points LLC and the Natural Products Association. Igbokwe-Curry earned a B.S. in Communications from the University of Texas at Austin and a J.D. from Howard University School of Law.

FCC Reminds RDOF Support Recipients of Upcoming Milestones

The FCC's Wireline Competition Bureau issued a public notice providing guidance to Rural Digital Opportunity Fund (RDOF) support recipients regarding the obligation of all recipients to meet the upcoming third or fourth-year service milestones.


The bureau said for those RDOF carriers authorized to receive RDOF funding in 2021, the fourth-year service milestone requires building out to at least 60% of that support recipient’s RDOF locations. For those RDOF carriers authorized to receive RDOF funding in 2022 and 2023, the third-year service milestone requires building out to at least 40% of that support recipient’s RDOF locations.


The bureau also reminded RDOF carriers for reporting in the HUBB portal, carriers must report the Fabric location IDs associated with these locations based on a list of eligible location IDs for each carrier. Additionally, RDOF recipients must notify the bureau if they cannot meet the third or fourth-year service milestone, and those recipients that defaulted early on portions of their RDOF authorized areas but still receive RDOF support elsewhere in the state must continue to comply with notification requirements.

PK Seeks Deadline Extension on IP Interconnection NPRM

Public Knowledge (PK) filed a motion requesting the FCC grant an extension of the deadlines to file comments and replies on the NPRM examining the interconnection requirements imposed on ILECs. PK said the government shutdown caused many complex proceedings with overlapping stakeholders to be due during the holiday season. PK requested the FCC extend the deadline for comments to January 26, 2026, and the deadline for replies to February 25, 2026. The due date for comments on the NPRM is currently set for January 5, 2026.

INCOMPAS has filed a letter of support for PK's motion and will alert members when the Commission has reached a decision on the request.

State Lawmakers Urge Release of BEAD Nondeployment Funds

Over 160 state legislators sent a letter urging Secretary of Commerce Howard Lutnick to release the remaining BEAD Program funds for nondeployment purposes. They said nondeployment funds are poised to support a range of critical activities, such as:

  • Building AI infrastructure
  • Streamlining permitting and pole attachment processes
  • Developing the telecom workforce
  • Improving middle mile and cellular networks
  • Enhancing cybersecurity and emergency services
  • expanding telehealth and education opportunities
  • Fostering broadband adoption and affordability

Senators Introduce Legislation on AI in Robocalls

Sens. John Curtis (R-UT) and Richard Blumenthal (D-CT) introduced legislation that would require robocalls to notify consumers when artificial intelligence (AI) is being used in calls or messages. The bill would also increase penalties for anyone using AI to impersonate others with the intent to defraud, cause harm or wrongfully obtain valuables.

Reps. Introduce Bill to Increase Penalties for Unsolicited Robocalls

Reps. David Kustoff (R-TN) and Deborah Ross (D-NC) introduced legislation that would increase penalties on companies and individuals for unsolicited robocalls. Under this legislation, willful or knowing violations of the Telephone Consumer Protection Act could result in up to one year in prison. In contrast, repeated or excessive violations could result in up to three years. It also raises the maximum fine for falsifying caller ID information from $10,000 to $20,000.


Sen. Catherine Cortez Masto (D-NV) introduced the Senate companion version of this bill.
