INCOMPAS CEO Comments on Reintroduction of AICOA

Last week, the American Innovation and Choice Online Act (AICOA) was reintroduced.


INCOMPAS CEO Chip Pickering said that this is "a disappointing step backward that threatens the internet economy and imports foreign regulations that have been proven to chill innovation. This legislation is a blunt instrument that would disrupt the integrated services consumers rely on daily, from seamless streaming bundles to reliable e-commerce delivery, while undermining the investment necessary to build next-generation networks.


AICOA draws directly from the European Union's Digital Markets Act, a regulatory framework that has entrenched incumbents, degraded digital products, weakened privacy protections and harmed the small businesses that depend on integrated tools to reach customers. At a time when the United States is competing fiercely with China and other nations for global leadership in AI and advanced technology, Congress should not be imposing the same heavy-handed restrictions that have contributed to Europe's innovative stagnation.


AICOA would break the digital ecosystem that drives American innovation and tells the next generation of entrepreneurs that success invites government-imposed restrictions, while discouraging the investment and risk-taking that have made American technology the envy of the world. Competition should be driven by the market and consumer choice, not by government-mandated design.


INCOMPAS urges Congress to reject this harmful legislation and pursue policies that strengthen competition, expand consumer choice, and ensure the United States continues to lead in the technologies that will define the future."

Rail Innovation Depends on Broadband Connectivity

INCOMPAS CEO Chip Pickering published a blog explaining why robust broadband connectivity is the foundation for modern rail innovation and the broader technologies transforming America's critical infrastructure, and why Congress must advance the Broadband and Telecommunications RAIL Act to ensure those networks can be built without unnecessary delay.


In the blog, Pickering said that at "a recent Senate Commerce Subcommittee hearing on Surface Transportation, Freight, Pipelines, and Safety, Association of American Railroads President and CEO Ian Jefferies made a point that should resonate far beyond the rail industry: technology is transforming the systems that move America...


He is right. Innovation is modernizing critical parts of our economy, and rail is a powerful example. But there is another essential piece of this story. None of this works without robust broadband connectivity...


Technology is helping railroads become safer, smarter, and more efficient. Broadband is what connects that technology to the real world. Congress should recognize that connection and advance policies, including the Broadband and Telecommunications RAIL Act, that help build the infrastructure America needs for the next century of innovation."

FCC Seeks Comment on Pole Attachment Regulations

The FCC's Wireline Competition Bureau issued a public notice reminding states that regulate pole attachments of their obligation, pursuant to Section 224, to issue and make effective rules and regulations implementing their regulatory authority over pole attachments. It also said these states must regulate the rates, terms and conditions of pole attachments and have established procedures for resolving pole access complaints.


Additionally, the Bureau said there have been reports of challenges to deployment stemming from state regulation of pole attachments, or the lack thereof, and the potential for noncompliance with the FCC’s rules pertaining to reverse preemption.


Lastly, the Bureau is seeking comment on the status of reverse preemption state regulation and jurisdiction over pole attachments, as well as the FCC’s jurisdiction in the face of incomplete or inadequate state regulation. Comments are due July 13 with reply comments due July 27.

Unused Funds Available for Rural Health Care Program

The FCC's Wireline Competition Bureau issued a public notice announcing, in consultation with the Office of the Managing Director, the amount of unused Rural Health Care (RHC) Program funds carried forward for funding year 2026. The Bureau directed USAC to carry forward up to $226.42 million in unused funds to the extent necessary to satisfy FY 2026 RHC Program demand.
