INCOMPAS Applauds Supreme Court's USF Ruling

The highly anticipated U.S. Supreme Court opinion in FCC v Consumers' Research was published last week. In a significant 6-3 decision, the court reversed the Fifth Circuit and upheld the constitutionality of the Universal Service Fund (USF) contribution mechanism under the nondelegation doctrine.


The Court rejected arguments that Congress impermissibly delegated its taxing power to the FCC and that the FCC’s reliance on the private Universal Service Administrative Company (USAC) violated constitutional separation of powers principles. The decision removes a significant legal cloud over the USF, while simultaneously highlighting the urgent need for congressional reform.


“INCOMPAS welcomes this decision given the importance of USF in bringing telecommunications and broadband services to rural America. Our members have utilized these funds to bridge the digital divide and deliver necessary services to consumers and community anchor institutions across the country," said INCOMPAS CEO Chip Pickering.


"While we applaud the Court’s findings in this case, Congress and the FCC must take immediate action to reform the provision of universal service funds and stabilize a contribution factor that continues to inch ever higher," he added. "INCOMPAS is committed to working with policymakers to identify solutions that will put the program on a smart and sustainable path forward.”


Court Also Addresses Unsolicited Faxes


The Supreme Court also recently issued an opinion reversing and remanding a judgment from the U.S. Court of Appeals for the 9th Circuit that involves a California district court appeal relating to a 2019 FCC declaratory ruling on unsolicited faxes. The Supreme Court held a district court is not bound by the FCC’s interpretation of the Telephone Consumer Protection Act and it should interpret the statute as courts traditionally do under ordinary principles of statutory interpretation, affording appropriate respect to the agency’s interpretation.

FCC Makes Unused Funds Available for Rural Healthcare Program

The FCC's Wireline Competition Bureau issued a public notice announcing, in consultation with the Office of the Managing Director, the amount of unused Rural Health Care (RHC) Program funds carried forward for funding year 2025. The bureau directed the Universal Service Administrative Company (USAC) to carry forward up to $129.3 million in unused funds to the extent necessary to satisfy FY 2025 RHC Program demand. 

Klobuchar, Clyburn Oppose Recent BEAD Policy Notice

Sen. Amy Klobuchar (D-MN), Rep. James Clyburn (D-SC), et al. sent a letter to Commerce Secretary Howard Lutnick expressing opposition to the recent policy notice that modifies and replaces certain requirements outlined in the BEAD notice of funding opportunity.


They urged Lutnick to ensure states receive the full funding and flexibility they retained prior to the issuance of the restructuring notice to fully meet these statutory objectives. They asserted the policy notice appears to allow applicants to exclude certain unserved locations and such an allowance would defy bipartisan congressional intent, which was predicated on the understanding that public investment was needed to achieve universal service precisely because building the infrastructure to cover many rural areas was too costly to be profitable. They also said the notice removes specific requirements that ensured providers would provide a low-cost internet option for low-income customers.
