INCOMPAS CEO Addresses AI Evolution, Permitting Reform at Broadband Breakfast Event

Last week INCOMPAS CEO Chip Pickering (pictured above at right) was a featured panelist during a day-long event on Data Centers, Nuclear Power and Broadband, hosted by Broadband Breakfast.


On the Data Centers, AI and Nuclear Energy panel, Pickering spoke extensively on the rapid evolution of artificial intelligence (AI), the opportunity America has to develop the infrastructure to keep up with its growing demand and the need for permitting reform in the age of AI.


“If we can have shot clocks, and we can have date certainty, and if we can begin to have the possibility of national security waivers, we could move quickly. We are in a global race, national security race, and economic race with our rivals who are not doing the same type of permitting that we do," he said. "It’s not going to take them extensive time, with a national imperative to build their infrastructure, while we have a have a process that can take sometimes 10 to 15 years for major projects. Now that’s just a fiber route.”

Williams Joins INCOMPAS to Support AI Initiatives

Sen. The group discussed the future of artificial intelligence (AI), including the networks, infrastructure and energy solutions required to support growth of the technology. 

Keith Matthews Promoted to Director of Communications

Congratulations to Keith Matthews, who has been promoted to the role of director of Communications for INCOMPAS. In his new role, Keith will be directly responsible for ensuring the execution of a unified media and communications strategy in support of INCOMPAS’ priorities and strategic goals related to policy initiatives, membership and event objectives.

Matthews joined INCOMPAS in January 2024, serving as Digital Media Manager where he was responsible for amplifying the association’s digital brand, PR and influence within the industry. He was instrumental in overseeing the launch of INCOMPAS’ new website and growing the association’s year-over-year digital media presence.

Supreme Court Holds Oral Arguments in Contributions Case

The U.S. Supreme Court held oral arguments last week in the case reviewing the U.S. Court of Appeals for the 5th Circuit decision that granted Consumers’ Research, et al.’s petition for review of the first quarter 2022 universal service contribution factor.


The Justices' questions focused specifically on the Universal Service Fund (USF) statute itself, and if Congress provided the FCC a limit, whether qualitative or quantitative, enough to satisfy an intelligible principle standard. Their questions focused very little on the operation of USF itself, whether contributions are a fee or a tax, or if any delegation or subdelegation was unconstitutional. Counsel for the FCC argued the nondelegation doctrine should be revived, however, this is not the right case to do so.

The Court's opinion should be released in June or early July.

Information Collection in NG 911 Order Effective March 25

An FCC notice was published in the Federal Register announcing the Office of Management and Budget approved a new information collection associated with certain rules adopted in a 2024 Next Generation 911 report and order.


The FCC also amended the rules to remove certain paragraphs advising compliance with the information collection requirements was not required until the FCC obtained OMB approval.


Compliance with Section 9.31(a) through (c) (valid requests for delivery of 911 traffic in Internet Protocol-based formats) and 9.34(a) and (b) (modification of NG911 requirements by mutual agreement), added in the final rule published on September 24, 2024, and effective November 25, 2024, is required as of March 25, 2025.

FCC Issues Procedures for 2025 Access Charge Tariff Filingss

The Pricing Policy Division of the FCC's Wireline Competition Bureau issued an order establishing procedures for the 2025 annual access charge tariff filings and tariff review plans for ILECs. The order:

  • Sets an effective date of July 1, 2025, for annual access charge tariff filing
  • Establishes the dates for filing petitions to suspend or reject an ILEC’s tariff filing and replies to petitions
  • Addresses service of the petitions and replies

Non-Dominant IXCs Annual Certification Filing Due May 1

The FCC's Wireline Competition Bureau issued a public notice reminding nondominant interexchange carriers to submit annual filings by May 1, 2025, certifying compliance with their geographic rate averaging and rate integration obligations, pursuant to Section 64.1900. Section 254(g) requires providers of interexchange telecommunications services to charge rates to subscribers in rural and high-cost areas no higher than urban areas and charge rates in one state no higher than rates charged in other states.

House Subcommittee Holds Hearing on Grid Reliability

On March 25, the House Subcommittee on Energy, held a hearing titled Keeping the Lights On: Examining the State of Regional Grid Reliability.


"Too many electric-generating facilities have been retired in recent years while new and emerging technologies are increasing the need," said Chairman Bob Latta (R-OH). "It is critical that we meet the growing demand for power, the need to secure it, and address the reliability challenges confronting our electric industry.”
