| | | Supreme Court Holds Oral Arguments in Contributions Case |
The U.S. Supreme Court held oral arguments last week in the case reviewing the U.S. Court of Appeals for the 5th Circuit decision that granted Consumers’ Research, et al.’s petition for review of the first quarter 2022 universal service contribution factor.
The Justices' questions focused specifically on the Universal Service Fund (USF) statute itself, and if Congress provided the FCC a limit, whether qualitative or quantitative, enough to satisfy an intelligible principle standard. Their questions focused very little on the operation of USF itself, whether contributions are a fee or a tax, or if any delegation or subdelegation was unconstitutional. Counsel for the FCC argued the nondelegation doctrine should be revived, however, this is not the right case to do so.

| | | Information Collection in NG 911 Order Effective March 25 |
An FCC notice was published in the Federal Register announcing the Office of Management and Budget approved a new information collection associated with certain rules adopted in a 2024 Next Generation 911 report and order.
The FCC also amended the rules to remove certain paragraphs advising compliance with the information collection requirements was not required until the FCC obtained OMB approval.
Compliance with Section 9.31(a) through (c) (valid requests for delivery of 911 traffic in Internet Protocol-based formats) and 9.34(a) and (b) (modification of NG911 requirements by mutual agreement), added in the final rule published on September 24, 2024, and effective November 25, 2024, is required as of March 25, 2025.
| | | FCC Issues Procedures for 2025 Access Charge Tariff Filingss |
The Pricing Policy Division of the FCC's Wireline Competition Bureau issued an order establishing procedures for the 2025 annual access charge tariff filings and tariff review plans for ILECs. The order:
- Sets an effective date of July 1, 2025, for annual access charge tariff filing
- Establishes the dates for filing petitions to suspend or reject an ILEC’s tariff filing and replies to petitions
- Addresses service of the petitions and replies
| | | Non-Dominant IXCs Annual Certification Filing Due May 1 | The FCC's Wireline Competition Bureau issued a public notice reminding nondominant interexchange carriers to submit annual filings by May 1, 2025, certifying compliance with their geographic rate averaging and rate integration obligations, pursuant to Section 64.1900. Section 254(g) requires providers of interexchange telecommunications services to charge rates to subscribers in rural and high-cost areas no higher than urban areas and charge rates in one state no higher than rates charged in other states. | | | House Subcommittee Holds Hearing on Grid Reliability |
On March 25, the House Subcommittee on Energy, held a hearing titled Keeping the Lights On: Examining the State of Regional Grid Reliability.
"Too many electric-generating facilities have been retired in recent years while new and emerging technologies are increasing the need," said Chairman Bob Latta (R-OH). "It is critical that we meet the growing demand for power, the need to secure it, and address the reliability challenges confronting our electric industry.”
