INCOMPAS Comments on DoJ's Proposals in U.S. v Google

INCOMPAS released the following statement responding reports in Bloomberg indicating that the Department of Justice (DOJ) will seek radical remedies following the verdict in U.S. v Google that would undermine the United States’ position as a global technological leader and put American innovation at risk: 


“The Department of Justice's leaked remedy proposals undermine basic, long-standing principles of antitrust law designed to protect consumers and foster a robust, competitive marketplace where innovation is encouraged,” said INCOMPAS CEO Chip Pickering on November 19.


"By recommending heavy-handed, overreaching remedies that would break popular Google products, the DOJ’s proposals threaten to set a dangerous precedent for other private sector companies that could chill investment in innovation, an outcome that would put American national security and the ability of the United States to compete on the global stage at risk," he added. "We hope the court will reject these radical proposals and consider the broader impact of its decision.”

Robotext Rule Goes Into Effect January 27

The FCC's Consumer and Governmental Affairs Bureau issued a public notice announcing an effective date of January 27, 2025, for Section 64.1200(f)(9) (delivery restrictions) adopted in the report and order on robotexts. The FCC said the new rule makes it clear prior express written consent under the Telephone Consumer Protection Act must be to one seller at a time.

Chairwoman Rosenworcel Announces Departure from FCC

Chairwoman Jessica Rosenworcel announced that she intends to depart the FCC on January 20, 2025. In a press conference after the November Open Meeting, Rosenworcel noted several accomplishments during her tenure as chair, including setting up the largest broadband affordability program in history and connecting over 17 million students caught in the homework gap to hotspots and other devices as learning moved online.

FCC Issues Tentative Agenda for December Open Meeting

The FCC issued a tentative agenda for its December 11, 2024, open meeting, where it will consider:


  • Facilitating Broadband Buildout: A report and order that would adopt targeted modifications to the requirements for letters of credit that recipients of Universal Service Fund high-cost support awarded through a competitive process must obtain.
  • Expanding Unlicensed Use of the 6 GHz Band: A third report and order that would expand unlicensed use of the 6 GHz band by very low power devices in two additional subbands, making a contiguous 1200 megahertz of spectrum available for use by these devices.
  • Broadcast Rule Update: An NPRM that would amend its rules for radio and television stations to reflect current application processing requirements, clarify and harmonize provisions, and remove references to outdated procedures and legacy filing systems.

Fifth Version of National Broadband Map Now Available

The Broadband Data Task Force, together with the Office of Economics and Analytics, issued a public notice announcing the release of the fifth version of the National Broadband Map. The map depicts fixed and mobile broadband availability data as of June 30, 2024, based on data submitted by internet service providers as part of the Broadband Data Collection.

Public Safety Bureau Provides Guidance on NG 911 Order

The Public Safety and Homeland Security Bureau issued a public notice providing guidance on the report and order about expediting the transition to NG 911.


The rules in the order are effective November 25, 2024, and define the obligations of originating service providers to deliver 911 traffic to NG 911 networks as those networks are established by 911 authorities. The new rules also authorize 911 authorities to make Phase 1 and Phase 2 valid requests to OSPs for delivery of 911 traffic in IP-based formats and require OSPs to comply with such requests within specified deadlines.
