INCOMPAS Comments as DOJ's Google Ad Tech Case Closes

INCOMPAS CEO Chip Pickering released a statement following closing arguments in the remedy trial for the Department of Justice’s (DOJ) antitrust case against Google’s ad tech business:


“This remedies trial has reinforced the critical principle that successful and innovative companies should be encouraged, not dismantled. True competition in the marketplace, not government-mandated restructuring, is what drives innovation and benefits consumers. Throughout the trial, witnesses explained that the DOJ’s untested proposed remedies would cause harm to the small and medium-sized businesses that depend on affordable ads to reach customers on different mediums. We urge the court to reject the remedies proposed by the government, including a forced divestiture, which would be incredibly disruptive and an unprecedented overreach that would harm the entire digital ecosystem."

FCC Announces Tentative Agenda for October 28 Open Meeting

The FCC announced a tentative agenda for its October 28 open meeting, where it will consider:

  • IP Interconnection – An NPRM that examines the interconnection requirements imposed on ILECs, and seeks comment on ways the FCC can facilitate a successful transition to all-IP interconnection for voice services while retaining oversight in areas of public safety and consumer protection.
  • Empowering Broadband Consumers Through Transparency – An FNPRM that proposes to eliminate certain broadband label requirements and seek comment on other ways to streamline the broadband label rules to reduce compliance burdens while preserving their consumer benefit.
  • Improving Verification and Presentation of Caller Identification Information – An FNPRM and public notice that proposes to give consumers accurate caller name and other information, proposes to simplify, streamline or eliminate outdated robocalls requirements, and provide notice that the FCC intends to dismiss certain older petitions for reconsideration and applications for review.
  • Protecting Against National Security Threats through the Equipment Authorization Program – A second report and order and second FNPRM to take the next steps in modifying the equipment authorization program to protect networks and communications supply chain against national security threats.
  • Deleting Obsolete and Duplicative Wireless Rules – A direct final rule that would move to delete approximately 400 obsolete and duplicative wireless rules.
  • Space Modernization for the 21st Century – An NPRM that proposes overhauling its rules for licensing space and earth stations to increase speed, predictability, and flexibility to support the American space economy.
  • Upper Microwave Flexible Use Service – An NPRM on ways to encourage more intensive use of spectrum bands above 24 GHz shared between the terrestrial upper microwave flexible use service and the fixed-satellite service.
  • Fifth Next Gen TV Further Notice – An FNPRM on steps to support and accelerate the nation’s ongoing voluntary, market-based broadcast television transition to Next Gen TV by removing regulatory obstacles and giving flexibility to broadcasters.
  • Incarcerated Persons Calling Services – A report and order, order on reconsideration and NPRM that would establish new interim audio and video incarcerated people’s communications services rate caps and correctional facilities rate additives for correctional facility cost recovery, and seek comment on establishing permanent rate caps and rate additives.

ATIS Submits Information on Call Authentication Standards

ATIS filed a letter to provide additional information on certain call authentication standards developed by its Non-IP Call Authentication Task Force, which the FCC sought comment on in the April 2025 NPRM. ATIS said the information explains the processes by which these standards are developed.

FCC Asks Supreme Court to Review CPNI Violations Decision

The FCC filed a petition for writ of certiorari with the U.S. Supreme Court, seeking review of a U.S. Court of Appeals for the 5th Circuit decision that vacated a 2024 FCC order fining AT&T more than $57 million for CPNI violations. The FCC said the circuit decision conflicts with recent decisions of two other courts of appeals that have rejected similar Seventh Amendment challenges to the FCC penalty scheme.
