INCOMPAS Comments on Google Search Remedy Trial Result

Last week the U.S. District Court for the District of Columbia ruled in the United States et al. v. Google. INCOMPAS CEO Chip Pickering released the following statement:


“The court’s decision to set aside the DOJ’s most far-reaching remedies is right and protects consumers from proposals that would have broken products like Chrome and Android, solutions that would have harmed consumers and undermined competition in online marketplaces. This outcome makes clear that antitrust enforcement should be about protecting consumers.


“At the same time, the ruling highlights the competition in the online search ecosystem driven by innovations in AI. By acknowledging these realities, the court affirmed that innovation, market dynamism, and consumer welfare must remain at the center of competition policy.”

INCOMPAS Comments on House Committee Approval of FY26 Energy and Water Development Act

INCOMPAS CEO released a statement after the House of Representatives passed the Energy and Water Development and Related Agencies Appropriations Act, 2026


Pickering began, "INCOMPAS applauds the House Appropriations Committee’s approval of the FY26 Energy and Water Development Act, which recognizes that America’s digital infrastructure and competitive telecommunications markets depend on abundant, reliable, and resilient energy systems.


"As our nation races to maintain technological leadership in artificial intelligence and next-generation computing, we cannot afford to fall behind in the energy infrastructure that powers these critical national capabilities.


"The competitive service providers, hyperscalers, infrastructure players, start-ups, and investors that INCOMPAS represents are building the critical tools that will define America’s economic future. Still, they require massive amounts of reliable power to operate. China understands this equation and is aggressively expanding its energy capacity to fuel its AI ambitions. We must match and exceed their determination."

Carr Proposes to Reverse E-Rate Service Expansions

FCC Chairman Carr is circulating two items to be voted on that would reverse decisions that expanded COVID spending programs: 



Carr asserted the prior FCC decisions exceeded the FCC’s authority, which Congress limited to funding connections at schools and libraries.

FCC Issues Small Entity Compliance Guides

Last week the FCC issued two small entity compliance guides:


  • Letters of Credit Order: The December 2024 report and order that adopted targeted modifications to the requirements for letters of credit that recipients of Universal Service Fund high-cost support awarded through a competitive process must obtain. The guide provides information on compliance requirements, recordkeeping and reporting requirements, and the implementation date.
    
  • Equipment Authorization: The May 2025 report and order that strengthens requirements and oversight relating to telecommunications certification bodies, measurement facilities and accreditation bodies to help ensure the integrity of these entities for purposes of its equipment authorization program. The guide provides information on compliance requirements, recordkeeping and reporting requirements, and the implementation date.

House Small Business Committee Holds Broadband Hearing

The House Committee on Small Business held a hearing on September 3, 2025, entitled Wired for Growth: How Expanding Broadband Can Revitalize Rural Small Businesses.


Witnesses included:

  • Jeff Vander Werff, VWF
  • Karen Jackson-Furman, West Kentucky & Tennessee Telecommunications Cooperative.


During the hearing, the committee examined how expanding broadband access can help rural small businesses compete, grow, and sustain local economies. Members explored the effectiveness of federal broadband programs, challenges in deployment, and the role of different technologies, including fiber, satellite and fixed wireless.

House Appropriations Approve Agency Spending Bill

The House Appropriations Committee approved the financial services and general government appropriations bill for fiscal year 2026, which among other things includes funding for the FCC and Federal Trade Commission.


The bill provides a total discretionary allocation of $23.341 billion, which is approximately $410 million below the FY 2025 allocation and a 7.9% cut from the fiscal year 2025 enacted discretionary appropriation.
