President's Comments

As IOP president, one of the great opportunities is to travel and attend events with other states. I attended President’s Council in January and was fortunate to visit with many members from the entire country. Many states have been able to pass laws that combat vision plan abuses, but unfortunately most of these laws haven’t had great enforcement. While it would be great to move forward with legislation to combat vision plan abuses, at this point I feel it makes more sense to see if other states are able to see actual benefits from the laws they have passed.


The IOP is excited to announce a monthly virtual lunch meeting. The meeting will be on the second Thursday of each month, with the first meeting scheduled for Thursday,

March 13 from 12:30 to 1:00 pm Mountain Standard Time. This is an opportunity to ask the IOP Board questions and to get updates on new events in the state. Please carve out time to attend.


The IOP had our annual Day at the Capitol on February 3. This year was cut shorter than we would like as the House of Representatives ran long on their morning session and most of the members of the House didn’t arrive until twenty minutes past our start time. It was still great being able to connect without our local legislators. The continuing education was amazing as always, and I would like to give a special thanks to our speakers, Dr. Scott Lewis, Dr. Marshall Ford, and Dr. Aaron Bronner.

Hello IOP Members,


This is the first legislative session in multiple years in which the IOP has not introduced some form of scope expansion legislation. We will, however, continue the talks with legislators for future introduction. There have been two meetings with Speaker Moyle this session to continue to hopefully build on that relationship.


We were lucky to have great speakers for CE lectures at Day at the Capitol (DATC) in early February. Due

to the amount of attendance from ODs, or lack thereof, the IOP is looking to make changes to the event.

The goal for DATC is to keep communication open with legislators so we may look at different ways to do that. We understand even having the event on a Monday is difficult to manage work schedules, so please be on the lookout for changes.


The main topic at DATC was surrounding Vision Benefit Managers (VBM) abuse. VBMs are organizations

that administer vision care plans and benefits. Everyone knows about the issues with reimbursements,

but it goes much deeper than that. From limiting patient choice to being forced to use specific labs, VBMs continue to dictate too much. This is an area of discussion for the IOP and possible future legislative efforts. Arkansas recently passed VBM legislation, click here for more details:

The legislative committee is excited to announce the launch of “Bites and Insights.” These short, 30-minute Zoom meetings are open to any IOP member and they will take place on the second Thursday of every month from 12:30-1:00 pm MST starting Thursday, March 13th. The goal of these is to get all IOP members engaged and involved, so please tune in! Look out for emails with the invites to those

meetings, if you haven’t seen them already.

2025 Mid-Session Report


Unless something drastic happens, I see the session ending by the end of March. Of course, things can always happen to delay or blow-up a Legislative Session. Everything seems to be moving smoothly, including the big picture issues like the water deal, tax cuts, and education funding.


So far there have been no bills introduced that would directly impact the profession of Optometry. There have been several bills that I have been following that would indirectly affect healthcare in general or how administrative rules are used and applied that I have been following. On February 7, 2025, IOP met with Speaker Mike Moyle (R-Star), and we had a positive meeting with him regarding the latest version of our Laser legislation. We will follow up with him later in the Session and see if he is willing to give us the “Green-Light’ to introduce a bill in the 2026 Legislative Session.

2. EyeMed Aetna Plans

Please be aware that doctors can request to join only the Aetna Vision network managed by EyeMed without any obligation to participate in any other EyeMed networks or plans. If you have any questions on this please let me know and I can get you more information.  

 

3.  VSP Policy Change

Effective January 1, 2025, VSP will increase the allowed amounts for daily replacement lenses under the “Covered Contacts and Visually Necessary Contact Lens” maximums by 15% to 20%. The policy notice is here.

 

4. Aetna Downcoding program

I have mentioned this in previous reports, but wanted to bring it to your attention again.

  • The program applies to 92 and 99 level 4 and level 5 codes. 
  •  If you start seeing downcoded claims on your explanation of benefits (EOB), it is recommended that you review the patient record and then appeal the claim.  
  • Typically, a provider will be removed from the program if they appeal at least 75% of their downcoded claims, and are successful in having at least 75% of those claims overturned.

  • example of strong documentation to support the level of care provided. Strong documentation is critical to successful appeals. 
  • A template for appeals related to 99xxx codes is available here.
  •  It is essential to begin appealing these claims as soon as possible. The AOA is asking members who are subject to this downcoding to reach out to the AOA’s TPC committee and keep them posted on your progress. They will be able to facilitate a second-level review through the AOA when appropriate.  

 

The most recent IMPAC (Informal Medicare Professional Advisory Council) meeting was cancelled and has yet to be rescheduled. I will send you updates when that happens.

Hello everyone!


     I was recently thinking about a goal we set in our office on sales of lenses and how that goal has been blown out of the water! What did we do differently that caused such an increase in the sale of this particular item - it was all in the phrasing/explanation of the service being provided! Have you looked at some of your “scripts” lately and tried to change them up? Sometimes just a few keywords like “doctor’s preferred” or “customized” can make all the difference in the patient’s perspective on said presentation.  Give it a try! Change up the phrasing you use in pretest or on the optical floor - it will feel weird at first, but when successful, you might wonder why you didn’t try it before. 


   Education planning is being finalized as we speak! With your feedback, we have 11 classes that we are excited to have you come to Boise in October to check out!  Dr. Scott Lewis will help us understand more about how vision therapy utilizes our brains and vision together. We are adding a hands-on eye anatomy lesson for you all to enjoy with the dissection of cow eyeballs - which are very similar to human eyeballs. We are bringing back Dr. Mile Brujic (he spoke in 2015) - I am most excited to see his lecture that is about the slit lamp and how it’s used!  There will be 11 CE credit hours available to collect for those certified and needing the credits - more details will be available soon! Watch for early registration information coming to you soon!

Final Notes

St. Luke's, Serum Tears - Dr. Bewley and I met with St. Luke's again today (March 4th). They hope to complete and implement the new serum tear policy by late spring. To start, they will only offer the service at the Fruitland and the Copper Point, Meridian labs. The St. Luke's Meridian hospital lab will not accept the orders. I will send the new policy as soon as possible. In the meantime, please continue to notify me if your orders are denied.


The U.S. District Court ruled that the beneficial ownership information reporting requirements are again in effect.

  • The deadline for reporting has been extended for most companies to March 21, 2025.
  • The U.S. Department of Treasury's Financial Crimes Enforcement Network has issued a notice with additional details about the updated deadlines.
