Some public defenders concerned as changeover to state office approaches

While newly appointed State Public Defender Eric Fredericksen said he has no concerns about their ability to serve defendants when the State of Idaho takes over the cost of public defense on Oct. 1, some public defenders are worried that the state won’t have enough attorneys to provide constitutionally adequate services.

Judge dismisses cruel and unusual punishment claims regarding a second execution attempt

After surviving an execution attempt earlier this year, Thomas Creech’s attorneys claimed that a second attempt by the state to execute him would amount to cruel and unusual punishment. “A second attempt to carry out his death sentence wouldn’t subject him to more than the Legislature authorized for his crime,” the judge wrote.

The Idaho Legislature has made only minor changes to the state's abortion laws since the U.S. Supreme Court restored its power to regulate abortion.
