UIC-28 MANIFEST TICKET REFRESHER
The Brammer Regulatory Department would like to provide a refresher on the Louisiana UIC-28 Manifest Ticket process. The Office of Conservation Environmental Division will periodically do manifest audits on transporters and disposal companies to check the UIC-28 forms. These companies are selected at random and during the audits they are looking to make sure EACH part of the manifest is filled out completely with signatures at every indicated signature line.  
 
The UIC-28 is comprised of four sheets. The white sheet is considered the original and consists of three parts. Part I is to be completed by the Generator to include information on the origination, description, and destination of waste. Part I needs to be signed by the Generator's authorized agent. Part II is completed by the Transporter in the presence of the Generator. This section is comprised of the transportation information and must be signed by the Transporter's agent. Part III is to be completed by the commercial facility or transfer station operator and signed by the facility's agent. The Disposal Facility retains this original form for no less than three years.
 
For the remaining sheets, the green page is for the Generator to retain once the Generator and Transporter have signed Parts I and II. The pink sheet belongs to the Transporter once the Disposal Facility has signed Part III. Finally, the yellow copy is what the Disposal Facility sends back to the Generator once it has completed and signed Part III.
 
The importance of the signature requirements should be clearly communicated to field personnel since the operator is responsible for getting the paperwork completed and signed before the waste ever leaves the location in order to avoid fines. The generator is responsible for proper handling and transportation of E&P Waste taken off site for storage, treatment, or disposal to assure its proper delivery to an approved commercial facility or transfer station or other approved storage, treatment or disposal facility according to LAC 43:XIX.503.D. If a violation is found, a civil penalty could be issued to either the Generator, Transporter, or Disposal Facility. Civil Penalties are approx. $250.00 per violation.

LOUISIANA STATE MINERAL AND ENERGY BOARD PASSES SHORT-TERM RELIEF
At a Special Mineral Board meeting held Wednesday April 29, 2020, conducted via Zoom, the Board passed two (2) Resolutions aimed at providing short-term relief to lessees of State Leases. Both Resolutions recognize the problems caused by the Covid-19 and oil price crises. The first Resolution enacts a "Temporary Moratorium" on the Board enforcing lease maintenance obligations and conditions (including for production, operations and rental payments) for the period beginning from March 11, 2020 and ending July 13, 2020, followed by a thirty (30) day "Resumption Period" for lessees to resume or begin operations, production or lease maintenance payments. It also provided for the postponement and rescheduling of deadlines for response to requests for reasonable development. The second Resolution provides for the postponement, delay, suspension and waiver of certain penalties for underpayments of royalties and other alleged violations of lease and statutory obligations. These Resolutions were intended to provide much needed lease maintenance relief during the short term. We anticipate the Board will reevaluate the constantly changing situation with Covid-19 and oil prices in July and August to determine whether and what relief may be necessary at that time. NEW LOUISIANA NATURAL GAS SEVERANCE TAX RATE
Effective July 1, 2020 through June 30, 2021, the natural gas severance tax rate in Louisiana will be $0.0934 per thousand cubic feet (MCF), as established by the Louisiana Department of Revenue.  The reduced natural gas severance tax rates (incapable rates) will remain the same. Read More
LOUISIANA SEVERANCE TAX EXTENSIONS
Per Revenue Information Bulletin No. 20.011:

The February 2020 monthly oil and gas severance tax return, payment, and report is due on April 25, 2020. The filing and payment deadline for this monthly severance tax period is extended to June 25, 2020. This is an automatic extension and no extension request is necessary. No penalties or interest will be assessed provided that the applicable monthly return, payment, and report for this severance tax period is submitted to the Department by the June 25, 2020, extension date.

This extension does not apply to severance tax returns, payments, or reports due on any other dates.

Some of my responsibilities are handling those specific needs of the client such as leasing, checking titles, settling damages for well locations and pipeline right of ways, putting together divisions of interest and managing the client's interest such as working interest or overriding royalty interest.

What do you enjoy most about working at Brammer?
One of the things I enjoy most is working with the wonderful people at Brammer. I couldn't ask for a better group to work with. I also enjoy the different projects that I work on for the clients. Each project I work on I learn something new each time. And foremost, I enjoy working with existing clients and meeting new clients. As I get to know and work with them I am always learning something new from them and the project at hand.

What do you think sets Brammer apart?
