BAMP Seeks Help for Information on Waiver
Requests and Denials
As you may know, the Governor, through the Department of Community and Economic Development,DCED, has been considering requests from members seeking a waiver of the Governor’s order to cease operations of all non-life sustaining businesses. Reports from the DCED is that they have received over
13,000 waiver requests and are moving as quickly as possible in making their determinations.

Since Monday, we have heard limited reports from our members that their requests have been granted and denied (most reports are that the applications have been denied). We are trying to ascertain what may be the basis for issuing the waiver or their denials and if there is any pattern in making these determinations.

In doing so, we are asking the members to share with us their determinations, either favorable or unfavorable and the language of your waiver requests so that we may conduct an analysis of the decisions to determine if there is, indeed, a reasonable nexus for the determinations. Rest assured, the information you provide will be kept confidential and not shared with any members. You should also include why or how your business operations are necessary in providing the life-sustaining shelter that is critically needed as our citizens are ordered to stay at home.
