IMPORTANT NOTICE TO ALL NAC MEMBERS & FRIENDS:
This notification is regarding ongoing participation in NAC’s pending nationwide litigation against VISA and Mastercard on behalf of ALL non-bank ATM Operators in the U.S. who operated their ATMs anytime between October 1, 2007, and November 5, 2025: National ATM Council, Inc., et al. v. Visa Inc., et al., No. 1:11-cv-01803-RJL in the United States District Court for the District of Columbia.
This is the lawsuit that NAC facilitated on behalf of the U.S. Independent ATM industry and which NAC has diligently prosecuted on ATM Nation’s behalf for the past 14 years.
The Court has directed issuance of notification to all U.S. ATM Operators (link below)
regarding the deadline for an ATM Operator to opt out of the case (by January 4, 2026) – if they do not wish to be a Member of the Class/Party to the lawsuit going forward, but instead want to be excluded from the litigation and pursue their own claims separately.
If you are an ATM Operator and want to remain a Class member, there’s nothing you need to do right now – by default all U.S. ATM Operators during the above timeframe are automatically included in the Class.
If you are an ATM Operator, you should have received this notice directly from the Court appointed Claims Administrator in one of the versions linked HERE.
If you did not receive the notice directly, you may wish to contact the Administrator to have your company’s name added to the mailing list for all future notices or other communications to Class Members. Please let your ATM Operator colleagues know about this initial notice being issued and the opt out deadline of January 4, 2026 if they wish to be excluded.
Going forward, NAC will be facilitating the offering of claims recovery support services to ATM Operators, via NAC’s senior management’s independent legal and consulting firm, Bruce W. Renard, P.A., under especially favorable terms for such services. Please stay tuned for more details on this important voluntary offering for ATM Nation.
