SAVE THE DATE! 2024 NGBS Consensus Committee Meeting

Washington, DC | Nov. 8-11, 2022

The 2024 NGBS Consensus Committee will meet at the National Housing Center in Washington, DC from the morning of Tuesday, November 8th until mid-day Thursday, November 10th. During this meeting, the Committee will discuss and vote on all public and Task Group-generated proposed changes for the 2024 NGBS. The public is welcome to attend.

Prior to the meeting, the Task Group recommendations will be posted to Home Innovation's website

Build-to-Rent Single-Family Homes Supported in NGBS Green Process

The volume for single-family homes being constructed and maintained as rental properties has increased substantially.

Build-to-Rent (BTR) clients have unique needs separate from traditional single-family and multifamily clients. As such, we have adjusted our administrative workflows to better accommodate.

At registration, we now ask if the projects are build-to-rent. When 'Yes' is selected, the Verifier is prompted to enter both developer and builder contact information. These can be the same.

If preferred, the developer will be shown on the NGBS Green certificate.

We anticipate that BTR developers would be the client who signs the agreement and presents the COI; however, we will accept the COI from either the developer or builder.

Invoicing is flexible. AXIS will generate an invoice with the developer as the client. However, any entity can pay an NGBS Green invoice. The key limitation is that the entity name on the invoice must match up with the client agreement we have on file. For example, Trion Development has contracted with Able Homes, Buster Homes, and Canter Homes to build their BTR product in three communities. Trion has signed the CA and provided the COI, but Trion wants Able, Buster, and Canter to pay the certification fees. Each company would send Home Innovation a check with the Trion invoice (so we can credit the correct homes with payment).

Inflation Reduction Act (IRA): 45L Builder Tax Credit

The Inflation Reduction Act of 2022 (IRA) was signed into law by President Joe Biden on August 16, 2022. This legislation includes significant investment in energy efficiency and clean energy technology. For the next several months, we will feature an element of the legislation related to the built environment.

The IRA renewed the 45L Home Builder Tax Credit through the end of 2032. A $2,500 credit is available for ENERGY STAR certification, and $5,000 is available for achieving the DOE Zero Energy Ready Home label. The credits are available for single-family homes and multifamily buildings up to three stories.

We would have loved to see 45L made available for comprehensive green building programs. However, we are choosing to view this new tax credit as positive. Energy efficiency is the cornerstone of green building, and the 45L program subsidizes a large portion of the hard and soft costs of achieving green certification. NGBS Green certification builds on many of ENERGY STAR and ZERH program requirements. Any builders considering upping their "green game" by seeking dual-certification should review our NGBS-ZERH Bronze Cookbook. Nashville Downtown Development Code Offers Height Bonuses for Green Certified Buildings & Neighborhoods

Nashville's Downtown Development Code Bonus Height Program (BHP) allows additional height for development in the downtown area that offers public benefit. 

Ten downtown sub-districts offer a bonus option for green building and green neighborhood certification. LEED Silver, Gold, and Platinum certifications are specifically identified in the policy, but other nationally recognized green certifications, including NGBS Green, are recognized.

Projects can also obtain additional height bonuses in certain sub-districts for other public benefit contributions. These include incorporating pervious surfaces, historic building preservation, publicly accessible open space or parking, inclusionary housing, civil support spaces, and/or hiding parking garages from view by locating them underground or (for above ground upper-level garages) behind habitable space.

QAP Watch
The following states have or will revise their Qualified Allocation Plans (QAP) for the Low-Income Housing Tax Credit (LIHTC) program. The summaries below indicate if NGBS Green certification is incentivized and provide information on how to submit comments or stay informed. If you're aware of any current QAP activity in your state or locale not listed here or included in our online QAP Round-Up, please contact us.

ALABAMA: The Alabama Housing Finance Authority (AHFA) published its draft 2023 QAP and accepted comments through mid-August. The draft QAP does not include any energy efficiency or green building criteria. Home Innovation submitted comments to encourage AFHA to incentivize comprehensive third-party green building programs, including NGBS Green, and ensure that funded projects meet the 2015 IECC.

ARIZONA: The Arizona Department of Housing published its draft 2022-2023 QAP and will accept comments to through September 16th. The QAP awards 10 points for NGBS Green (Silver or higher), Enterprise Green Communities, or LEED (Silver or higher) certifications. The QAP awards five points for HERS ratings of 55 or lower or DOE Zero Energy Ready Home achievement. NGBS Green Partners are encouraged to express support for the QAP's inclusion of third-party green certifications, including NGBS Green. For assistance on a comment letter, please contact us.

COLORADO: The Colorado Housing and Finance Authority (CHFA) published its first draft 2032-2024 QAP and a summary of expected changes. CHFA will accept comments here through October 1. All projects must obtain 2020 NGBS Green, 2020 Enterprise Green Communities, or LEED v4.1 certification. Projects that achieve higher levels of certification and/or are constructed to be "Electrification-Ready" will be considered more competitive. NGBS Green Partners are encouraged to express support for the QAP's inclusion of third-party green certifications, including NGBS Green. For assistance on a comment letter, please contact us.

DELAWARE: The Delaware State Housing Authority (DSHA) will host a Developers' Forum for its 2023-2024 QAP at 10AM on September 21st at DSHA's Liberty Court Community Center (1289 Walker Rd. Dover, DE 19904). NGBS Green Partners are encouraged to attend and share feedback on green building and resiliency requirements. The DE 2021-2022 QAP awards three base points for NGBS Green, Enterprise Green Communities, or LEED certification and two or three points for zero energy, passive house, and resilient construction.

IOWA: The Iowa Finance Authority released a preview of its 2023 QAP. In the 2022 QAP, green building certifications are recognized alternatives to the QAP's energy requirements, which include ENERGY STAR Multifamily New Construction and HERS ratings. The preview document does not identify whether not the green building programs will remain as recognized alternatives. We will continue to monitor and keep partners informed of developments.

KANSAS: Kansas Housing published its draft 2023 QAP. A public hearing is scheduled for September 7th from 11:30AM-1:00PM ET. The draft QAP does not include any energy efficiency or green building requirements. Written comments are accepted to until September 19th at 5PM ET.

OHIO: The Ohio Housing Finance Authority released the first draft of its 2023 QAP and accepted comments through mid-August. The draft QAP requires new multifamily developments to earn NGBS Green (Silver or higher), Enterprise, or LEED certification (Silver or higher). Rehabilitation and adaptive reuse projects must obtain green certification when feasible or meet alternative requirements. Home Innovation submitted comments that praised Ohio Home for recognizing credible third-party green building programs and requested that green building expectations for rehabilitation projects be clarified.

NEW MEXICO: The New Mexico Mortgage Finance Authority (Housing New Mexico) published its draft 2023 QAP and will accept comments to Jeanne Redondo through September 6th. The draft QAP does not include any energy efficiency or green building criteria.

SOUTH CAROLINA: The South Carolina State Housing Finance and Development Authority (SC Housing) published its draft 2023 QAP and comments were accepted through late August. The QAP would award five points for achieving NGBS Green, EarthCraft, Enterprise Green Communities, CHiP, or LEED for Homes certification. Home Innovation submitted comments that praised SC Home for recognizing credible third-party green building programs, including NGBS Green.
