When a police officer fails to videotape a civilian encounter, courts should instruct juries to take that into account, according to a new report by Berkeley Law’s Samuelson Law, Technology & Public Policy Clinic and the American Civil Liberties Union of Massachusetts.

In People v. Macabeo, the Calif. Supreme Court issued a ruling that strengthens privacy rights and curtails unlawful police searches. The Samuelson Clinic served as co-counsel and Prof. Chuck Weisselberg argued the case before the court.

The California Constitution Center presents its annual conference on the California Supreme Court, in partnership with the center’s friends at the Hastings Law Journal, the Bar Association of San Francisco, and the Institute of Governmental Studies. This event is eligible for seven hours of MCLE credit.
