Retired BC Lawyer Explains Sections of Bill 36

Retired BC lawyer, Gail Davidson, interpreted sections* of HPOA in a BC-wide Physicians and Health Professionals online meeting on Oct 26, 2023.

Details on the Bill 36 campaign and the Nov 9th BC Legislature event were shared.

*Interpretations are solely those of Gail Davidson. Feedback is welcome on errors, omissions, analyses. This review is a draft and does not examine the scope and consequences of regulations and bylaws to be made by appointees, Cabinet and the Minister, increased practice fees, the use of closure to pass the Act and other issues of concern.

What is Bill 36?

Health Professions and Occupations Act

View & Read Bill 36

Bill 36 was one of the largest bills ever passed in British Columbia, consisting of 645 sections and 276 pages, that received royal assent on November 24, 2022. Members of the BC legislature failed to fully consider or debate the 412 clauses. MLA Mike Farnworth made the motion to dispose (end) the debate, and that motion was carried.

The public was denied due democratic process to have a fully debated and considered bill, violating the BC government’s own Standing Order s. 84 (1)(2) of the BC Constitution Act (1996), s.45.
