Speaking for myself, I do not charge more for a Court appointment than I do for a regular real estate transaction. In fact, I often reduce my rate if the transaction goes well, without reducing my services. See below for more information on my commission rates and reductions.
Do not hesitate to use a Special Commissioner due to cost. In fact, it can help reduce the cost, time and stress of selling the home. Why? Because the nature of the appointment helps the parties realize that they need to find resolution and focus on the end goal of selling the home. It evens the playing field if one party is more "in control" or aggressive than the other.
This process does not render your client powerless. In fact, it can empower them by giving them a voice. It also does not give the Special Commissioner immense power. Their only power is the ability to request a hearing. The Judge may then bestow certain powers based on the circumstances. Also, the Special Commissioner cannot make a unilateral decision. The parties' agreements rule. It is a very fair and efficient process if understood and carried out correctly.
