In preparation for reporting requirements (paragraph 12 of the Grant Agreement), in compliance with the law establishing the CERTS program, Treasury published an information collection request (ICR), in support of obtaining authority to collect information. Although the ICR did not provide detail on the reporting requirements, it supposed be an online format and grantees will need to use ID.me to access it, via the Treasury online portal. The public can comment the ICR by Dec. 13, by clicking here.
On Nov. 19, Treasury announced their anticipated reporting timeline on its website. Treasury will not require reports for the third quarter of 2021; but will require the first quarterly report on Feb. 15, 2022. This report should include activities covering from the effective date of the CERTS grant agreement through the fourth quarter of calendar year 2021 (Dec. 31).
U.S. Senate letter finalized and sent! Three Senators championed the cause which would give CERTS grants the same tax treatment extended to grants for shuttered venues and restaurants for their pandemic relief funds. Senators Robert Casey, Charles Grassley, and Marsha Blackburn are asking colleagues to join them in urging Senate leadership to act quickly to exempt CERTS grants from federal taxation. This occurred after the House letter was organized (and sent) led by Reps. Panetta, LaHood, Sires, and Rose. They rallied 89 colleagues to support a tax-exemption for CERTS grant funds. Their bipartisan letter garnered 93 signatures, including the original signers. We provided a copy of the letter last newsletter.

MCSAC Meeting – On Nov. 5, FMCSA announced the next meeting of the Motor Carrier Safety Advisory Committee (MCSAC) will take place on Dec. 6-7, from 9:15 a.m. to 4:30 p.m. ET. Topics will include driver shortages and supply chain issues. Click here to register to participate in the meeting. The deadline for registration requests or to submit written materials for the meeting is TODAY, Monday, Nov. 29.
Entry Level Driver Training – The compliance date for FMCSA’s final rule on entry level driver training is Feb. 7, 2022. Operators providing pre-CDL driver training in-house must register with FMCSA via the Training Provider Registry, in advance of the compliance date. As there are several steps involved and FMCSA must review the registration, operators are encouraged to register now. Click here for more details on the registration process. Electronic Logging Devices – On Nov. 1, FMCSA provided notice on its website of issues related to mobile telecommunication carriers shutting down 3G networks to accommodate more advanced network services, including 4G and 5G. Older cell phones and other mobile devices will be unable to use the older 3G data services and may be incompatible with newer networks, this can affect electronic logging devices (ELDs) that rely on 3G networks as well. Operators should verify that their ELDs continue to meet FMCSA technical standards to remain in compliance with the ELD regulations. Click here to view the list of registered ELD providers.

COVID Relief Program Deadlines

On Nov. 19, the Small Business Administration (SBA) announced updated guidance on deadlines for the COVID Economic Injury Disaster Loan program (EIDL). SBA will accept applications for the EIDL and Targeted Advance programs through Dec. 31, and process applications until funds are exhausted.
