Late in the afternoon on June 19, 2026, Agenda item S94Z was added to a very lengthy June 23, 2026, Board of Supervisors agenda. This item was not viewable by the public until the morning of June 22, 2026. This agenda item had original attachments totaling 896 pages. A final 22-page late attachment was sent to the Board at 7:38 p.m. on June 22 by Sean Matsler of Cox Castle, the law firm for Dana Point Harbor Partners. It included additional discussion on the leases. Was this agenda item in compliance with the Brown Act? Was it compliant with CA Government Code Section 25528?
If you haven't read it in the local newspapers yet, the Orange County Board of Supervisors voted to continue the agenda item regarding new 66 Year Master Leases for the Marina and the Commercial Core, the hotels, and the drystack. Also included in the continuance is a Memorandum of Understanding (MOU) regarding day use boater parking, and a restaurant at the Sailing and Events Center.
These documents are lengthy and, if approved, will change the footprint of the harbor. We encourage all boaters to take the time to review the documents. Some items to consider:
- The MOU contemplates reducing the number of day-use boater parking spaces from 334 to 150 parking spaces.
- The MOU considers allowing DPHP a lease on part of the Sailing and Events Center for a restaurant. This space is currently used by non-profits like the Sea Scouts and West Wind Sailing for youth supported activities. (A public meeting to discuss the future of this important county asset is scheduled in August).
- The remaining term on the existing lease is 58 years. The new leases will be for 66 years.
At the Board of Supervisors Meeting, Supervisor Foley, requested several items be added to the leases:
- The first item was regarding a plan to assist displaced workers when the Marina Inn is demolished.
- The second item was a slip-rate stabilization policy for future rate increases.
We commend Supervisor Foley for addressing both items and hope she is successful in getting them included in the final leases.
