AB: New Submission Process for O-38 Applications |
On February 6, 2023, the AER released a new submission process for new well base maximum rate limitations (O-38) applications. Companies must now submit O-38 applications using the web form available on the AER website, aer.ca > Regulating Development > Rules and Directives > AER Forms > Directive Forms. Applications submitted by email will no longer be accepted.
The new web form also includes the following changes:
· Consultants submitting the web form on behalf of a company can now provide their contact information.
· Applicants are now asked to confirm that gas production from the well is conserved in accordance with Directive 060 requirements.

AB: Directive 050: Drilling Waste Management |
Directive has been updated to reflect the Government of Alberta’s January 2023 edition of the Alberta Tier 1 Soil and Groundwater Remediation Guidelines. The benzene soil endpoints in table 3 and benzene waste concentration values in table 4 have been updated.

Effective on January 1, 2023, the orphan fund fee will no longer be required under the amended Oil and Gas Conservation Regulations, 2012. Until changes have been implemented in IRIS, companies acquiring licences for the first time will receive an IRIS message to provide the Orphan Fund Fee.
Industry should not provide payment and should contact the ER Service Desk for further instructions.

SK: Retroactive Flowline Licence Application |
Since January 26, 2023, the ER has been working with developers to rectify an incorrect validation rule for retroactive flowline licence applications that denies the application when a user provides incomplete information for free standing liners.
Industry is advised to hold off on submitting retroactive flowline licence applications involving incomplete liner information until the issue is resolved. An industry release note will be issued by ER once the issue is resolved.

SK: Revised Directive PNG006
|
The changes concern requirements for set-backs, drainage area determination, provincial crown and freehold pooling, and horizontal gas wells. The directive title has been updated from “Horizontal Oil Well Requirements” to “Horizontal Oil and Gas Well Requirements” to clarify that the requirements are in relation to spacing and production associated with horizontal oil and gas production wells.

SK: Amended version of Directive PNG007 |
The revised version includes updates to the definitions, an update to the title of Directive PNG007 that clarifies the directive applies to the well completion, not the well itself; clarification in the public notice requirements; and the process for licensing off-target well completions.
The changes to Directive PNG007 are of a clarification nature and do not create new requirements for industry.

Following the provincial announcement on Jan. 18, 2023 of an implementation agreement with Blueberry River First Nations (BRFN), the BCOGC and Ministry of Energy are jointly releasing further information about the BRNF specific to the petroleum and natural gas industry.
The BRFN is structured to include interim approaches for activities, petroleum and natural gas (PNG) and forestry focussed, with longer term commitments of comprehensive planning processes, which will establish a new balance of treaty rights and healing of the environment with a sustainable regional economy.
In order to provide early guidance and information to the oil and gas sector, the BCOGC has posted a summary of “Rules for Oil and Gas Development” on its website.

BC: Dormancy and Shutdown Regulation (DSR) and Drilling and Production Regulation (DPR) |
On January 30, 2023, BCOGC announced that amendments were made to regulations related to the restoration of dormant and former oil and gas sites, including bringing timelines for restoration of pipelines and certain facilities into the Dormancy and Shutdown Regulation (DSR), enabling the Commission to accept alternative timelines for site restoration via an exemption application process, and clarifying restoration obligations in the DSR to ensure alignment with existing environmental regulations.
