Past Zoning, Variance, and OBI Updates
Board of Commissioners Zoning Hearing, December 19, 2023:
Z-49 2023 (GUTHRIES): 4774 Lower Roswell Road (next to the CVS on Johnson Ferry and Lower Roswell). Intent to change zoning in order to build a drive-through only, fast food restaurant (Guthries). The property is located on a tract size of 0.317 acres.
ECCA’s major concern was having a back-up of cars onto Lower Roswell Road. ECCA recommended that a traffic study be completed and analyzed prior to a vote by the Commissioners. DOT told the Commissioners that they had analyzed the completed traffic study and believed that Guthrie’s would not impair Lower Roswell Road traffic.

OB-67 2023 (CLOSED WALGREEN’S): 3033 Johnson Ferry Road/Waterfront Drive. Applicant, NPS Ventures, LLC, proposed a Settlement of Litigation regarding Cobb County Superior Court Case No. 23 102 242 (NPS Ventures, LLC v. Cobb County et al.) regarding case OB-65 of 2022. The applicant proposed a compromise with regard to the allowed NRC uses as well as other stipulations in a “Settlement and Compromise Communication” letter dated November 21, 2023.
ECCA recommended that the BOC not approve the “Settlement and Compromise Communication” letter dated November 21, 2023 without changes.
Commissioners accepted the “Settlement and Compromise Communication” letter with minor modifications and allowed restaurants with drive through service and child care centers be permitted uses but would require a traffic study.
