UPDATE: U.S. DOL Appeals Judge's Decision Blocking Overtime Rule


You may recall that on November 15th a federal judge struck down the overtime rule issued by the U.S. Department of Labor (DOL). On November 26th, the DOL filed an appeal.

Reminder: The ADA Covers Applicants, too!


On December 6th, the EEOC reminded us that the ADA protects applicants, as well as employees. The agency seeks damages including back pay/benefits/interest; front pay; compensation for mental anguish; punitive damages; and more.

Keep Yourself Safe: HR Director Found Individually Liable for FLSA Violations


On November 26th a federal court ordered an employer and its HR Director to pay more than $88,000 in back wages, liquidated damages, and civil money penalties for willful violations of the Fair Labor Standards Act (FLSA).

U.S. DOL Recovers $41M for Misclassified Workers


If you thought Lesson 2.4 above was tough, on December 17th the DOL published a year-end report announcing, “Since January 2021, we’ve recovered over $41 million in back wages for more than 28,000 workers who were misclassified as independent contractors."

OSHA Extends Deadline for Heat Stress Rule Comment


On December 2nd, OSHA announced it was extending the public comment period for its proposed rule to protect workers from extreme heat exposure in indoor and outdoor workplaces.
