This is the third in our 2026 Year in Preview series examining important trends in white collar law and investigations in the coming year. 2025 saw fundamental shifts in Foreign Corrupt Practices Act (FCPA) enforcement priorities under the first year of the second Trump Administration. FCPA and global anti-corruption landscape enters 2026 amid continued recalibration in U.S. enforcement priorities, a thinned but active federal enforcement apparatus, and increasingly assertive international counterparts filling perceived gaps left by shifting U.S. policy.

As we predicted in last year’s White-collar crime and investigations review, the second Trump Administration immediately imposed substantial changes to white-collar crime and investigations practices in the United States. These included: new priorities for the DOJ; a temporary pause and then a significant shift in its approach to enforcing the FCPA; a return to basics at the SEC’s Enforcement Division and other regulatory agencies; and a complete turnaround on oversight and enforcement in the crypto industry. These changes, coupled with the unprecedented personnel turnover and reduction in resources, mean 2025 saw the biggest pullback in white-collar and regulatory enforcement in the U.S. in decades.

Tencent Steps Up Internal Controls, Dismisses Over 90 Staff for Corruption Violations

Tencent Holdings uncovered more than 70 internal corruption cases last year, dismissing over 90 employees who crossed internal compliance “red lines” and referring more than 20 of them to police for suspected criminal activity, one of China’s largest internet firms reported today.
The cases involved serious violations of laws and regulations, including commercial bribery and duty encroachment, reflecting intensified internal controls. Tencent said it has consistently taken a zero-tolerance approach to misconduct in recent years.

The Fraud Hiding in Email Signups

Ecommerce merchants know the costs in time, revenue, and inventory of illicit chargebacks.
For many sellers, however, the damage starts with new accounts. Organized fraudsters may sign up hundreds of times, employing valid but fake email addresses.“Those fake accounts are being created for purposes like card testing with small-value transactions to see if the number is valid before attempting a bigger transaction,” said Diarmuid Thoma, the head of fraud and data strategy at AtData, an email verification and validation service.

From Mailbox To Bank Fraud: Check Theft Is Surging And How To Stop It

While the crime may seem like something from another era, mail theft is big business. Financial‑crime analysts at the Treasury Department’s FINCEN estimate check fraud accounted for about $21 billion dollars in losses during 2023 with a substantial portion of that amount originating with stolen mail. Making matters worse, these figures are undoubtedly low because 90% of mail theft goes unreported.
Starting in the early 2020s, mail theft from mail receptacles began increasing dramatically. According to Postal Inspection Service investigations and Department of Treasury data between Fiscal Year (FY) 2019 and FY 2023 there was a 139% increase in reports of mail theft from mail receptacles. Mail is stolen from residential mailboxes, USPS collection boxes, burglary of USPS facilities, robbery of USPS employees and through bribery and collusion with USPS employees. The significant rise in mail theft and associated financial crimes has often been attributed to organized criminal groups who consider mail theft and check fraud low-risk, high-reward financial crimes.

The digital overhaul sweeping global banking is forcing financial institutions to rethink the foundations of their internal control systems.As cloud platforms, AI engines and automated workflows are being tested and implemented, and quickly replace paper-based supervision and manual review, banks face a fundamental shift: internal control is no longer a static compliance function but an active, data-dependent discipline that must adapt in real time.For quality assurance and software testing teams, this shift brings both opportunity and pressure. Automated controls, continuous monitoring and model-driven decision-making require new testing standards, new governance mechanisms and far stronger resilience planning than in the past.These changes are playing out most visibly in large, complex organisations, particularly in the world’s major state-owned banks, where digital transformation programs run at industrial scale.

False Claims Act Settlements and Judgments Exceed $6.8B in Fiscal Year 2025

Settlements and judgments under the False Claims Act exceeded $6.8 billion in the fiscal year ending Sept. 30, 2025, Deputy Attorney General Todd Blanche and Assistant Attorney General Brett A. Shumate, head of the Justice Department’s Civil Division, announced today. That amount is the highest in a single year in the history of the False Claims Act. This year, whistleblowers filed 1,297 qui tam lawsuits, the highest number in a single year, and the government opened 401 investigations, including matters announced as Administration policy objectives. Settlements and judgments since 1986, when Congress substantially strengthened the civil False Claims Act, now total more than $85 billion.
“Stopping rampant fraud is a top priority, and this record-breaking year proves the False Claims Act remains one of the government’s most powerful weapons against fraud,” said Deputy Attorney General Todd Blanche. “We will continue to aggressively deploy it to protect taxpayer dollars and hold all fraudsters accountable.”

Building SOX-Ready Controls Without the Bureaucracy

Small manufacturers preparing for an IPO, merger, or private equity investment often face a sobering reality: investors want to see strong financial controls. The Sarbanes-Oxley Act (SOX) sets the gold standard for these controls. But many small businesses assume SOX compliance means drowning in paperwork and hiring expensive consultants.
It doesn’t have to. You can build SOX-ready internal controls that satisfy auditors and investors without creating a bureaucratic nightmare. The key is starting with what matters and building from there.
The payoff is real. Research published by the Harvard Law School Forum on Corporate Governance found that private firms with stronger SOX compliance received higher valuations when acquired by public companies. Being SOX-ready before you need to be can translate directly into better deal terms.
