INCOMPETENT AND BIASED BOARD TRIES TO OVERRIDE THEIR OWN DEPARTMENT'S HEARING OFFICER


As always, we made sure that housing providers were represented at the Rent Board meeting on March 19th.


The most important item of business was an appeal by a tenant against a hearing officer's decision on two items:

  1. The hearing officer did not support the tenant's claim that their rent, parking, and utility fees had been incorrectly calculated and should be reduced
  2. The hearing officer did not agree that the landlord's initial errors around the rent rollback and other rent assessments in 2023 meant that the landlord was not in "substantial compliance" and that therefore ALL subsequent rent increases should be reversed.


During the appeal hearing, some tenant members of the Board pushed back on the hearing officer's decision on item 1, even though they admitted they couldn't understand the calculations.


There was also an attempt to override the Hearing Officer's decision that the landlord's swift correction of errors meant that they were substantially in compliance with regulations and could therefore make subsequent rent increases.


After multiple rounds of voting, the final decision was to remand the detailed rent calculation back to the hearing officer, but to affirm the hearing decision that the landlord is substantially in compliance with Measure H and related regulations. This is a VITAL precedent that stops anti-landlord activists from using trivial administrative errors as "Gotchas" to stop all subsequent legal rent increases.


The blatant anti-landlord bias was only brought under control because of a technicality: the Rent Board only had six members present (out of 13), so all decisions had to be unanimous. If all the anti-landlord activist members of the board had shown up, they could have set a very dangerous precedent for any housing provider who makes the smallest error, even if the owner corrects it.


With a balanced board of tenants and experienced landlords, fair and equitable decisions could be made in much less time and at far less cost. Pasadena's voters overwhelmingly agree that we need a fair and balanced Rent Board.


BALLOT MEASURE UPDATE


Our ballot measure now rests with the City and we await their response. We are on their timeline and will keep you posted.


In order to qualify for the ballot, we will need signature gatherers, marketing and media consultants. We've carried out two voter surveys, which show an appetite for change. We can win if we can qualify for the ballot.
