Judge Blocks Illinois Stay at Home Order Extension, State to Appeal
Earlier today, a Clay County Circuit Court overturned Governor Pritzker's stay-at-home order, ruling that the Governor does not have the legal authority to issue such an order thereby blocking a new order from taking effect on May 1.
In response, Governor Pritzker noted that “this ruling has put the people of Illinois at risk.” The Governor has announced that the state, through the Illinois Attorney General, will appeal and will request a stay and there will be a status hearing in one week.

IWCC Withdraws Emergency Workers' Compensation Rule
This morning, the Illinois Workers’ Compensation Commission (IWCC) formally withdrew the emergency rule creating a presumption that an employee contracted COVID-19 at the workplace.
The IRA applauds IWCC's decision to reverse this drastic policy change, and will continue to work to protect the restaurant industry on this issue in the future.
The IWCC will be putting together a task force to look at all options relating to COVID-19.

Additional Ordinances Introduced in Chicago City Council
Several ordinances and resolutions were introduced at the Chicago City Council meetings last week related to the restaurant and hospitality industry. The IRA will continue to monitor the following legislation and provide updates on new developments.
Food Service Delivery Resolution
Alderman Andre Vasquez (40th) introduced a resolution calling on the Governor to exercise his emergency authority to cap the rates charged by third-party delivery services to restaurants and provide direct aid and relief to restaurants burdened by the stay at home order.

Hand Sanitizing Stations
Alderman Stephanie Coleman introduced an ordinance that would establish a public/private fund to assist in the provision of hand sanitizing stations that shall be placed in all government, commercial and residential facilities. It requires hand sanitizing stations to be prominently installed and maintained near entryways and elevator banks in places of public access including all airports, stores, sports stadiums, museums, music venues, concert halls, theaters and other places of public amusement, hospitals, clinics, and nursing homes, schools, libraries, park facilities, fire stations, police stations, as well as all other government buildings.

Emergency Procedure Compliance
Alderman Andre Vasquez introduced an ordinance that would
require businesses licensed by the City to comply with emergency procedures during a disaster or emergency. It specifically requires businesses that are deemed essential during the emergency to provide employees with personal protective equipment.

Outdoor Patios
Alderman Brian Hopkins (2nd) introduced an ordinance to further regulate outdoor patios. Specifically, it adds a penalty on liquor dealers for violation of the provision that prohibits the playing of any live or recorded music on a licensed outdoor patio. It also adds a penalty on amusement licensees for violation of the provision that prohibits playing of any live or recorded music on a licensed patio. Finally, it adds a penalty for regulated entertainment businesses to prohibit liquor dealers or public place of amusement businesses that prohibits any equipment that amplifies sound so as to generate sound louder than average conversational level at a distance of 100 feet or more from the property line of the property from which the noise is being generated.

Refuse Collection
Alderman Brian Hopkins (2nd) introduced a resolution to call on Governor Pritzker and Mayor Lightfoot to issue all necessary and appropriate Executive Orders to ensure that no residential or commercial garbage and recycling services are halted or suspended during the COVID-19 pandemic.

Workers Rights Resolution
Alderman Susan Sadlowski-Garza (11th) introduced a resolution calling on House Speaker Madigan, Senate President Harmon, and the other members of the General Assembly to place SJRCA 23, the Workers Rights Amendment, on the ballot to be voted upon by the people of the State of Illinois at the General Election to be held November 3, 2020.
