Standard Forms Revisions: Coming July 1ststd 
Revisions to the following RVAR standard forms are slated to 'go live' in zipForms on Monday, July 1st:
Purchase Agreement (similar changes to Lot/Land Purchase Agreement)
  • Review attached 'White Paper' for explanation of all revisions
  • Added Wire Fraud Alert paragraph
  • Expanded definition of Business Days to specify how to calculate Business Days, including when the first Business Day begins
  • Walkthrough changed from a presettlement inspection to a verification, with clarification that those entitled to participate in a presettlement verification be the Purchaser, Selling Agent and original inspector(s)
Inspection Addendum
  • Review attached 'White Paper' for explanation of all revisions
  • Changed definition of defects for the purpose of a home inspection to any of the following: "(1) that the plumbing (including well, well pump and septic system, if any), heating, air conditioning (if any), electrical system and appliances are not in safe working order; (2) that there are structural defects; and (3) that the roof leaks."
  • The Radon Inspection paragraph was changed to default to a Purchaser responsibility
  • Removed the requirement that the Wood Destroying Insect Inspection Report be dated no more than 60 days prior to settlement
Summary of Rights and Obligations of Sellers and Purchasers Under the Virginia Residential Property Disclosure Act
  • Added 'conveyance of mineral rights' as item for which Owner is making no representation
  • Expanded paragraph related to stormwater detention facilities
  • Expanded paragraph related to flood hazard areas
2019 New Lawslaws
July 1st marks the date that most new Virginia laws go into effect. There are two bills of particular interest to mention that will become law:  

*     Delivery of Incomplete POA/COA Packets - Recent conflicting court rulings in Virginia raised the question of whether the delivery of an "incomplete" disclosure packet in a Property Owners Association (POA) or resale certificate in a Condo Owners Association (COA) begins a buyer's ability to cancel the contract within the three-day right of rescission.  This bill clarifies that the delivery of an "incomplete" packet begins the three-day right of rescission.

*     Consumer Protection Act - This Virginia REALTORS®' bill will add unlicensed real estate activity to the Virginia Consumer Protection Act to allow for greater consumer protection against this illegal activity.
Advocacy @ Workadvocacy    
Advocacy @ Work is an article aimed at updating members on what is happening in our region regarding Economic Development and/or Governmental Affairs.
 
National Flood Insurance Program Extended - Some good news! The House and Senate passed an extension of the NFIP as part of the Disaster Relief bill until September 30th. We have heard from the National Association of REALTORS® Governmental Affairs staff that a lot of work has been taking place to make needed improvements and reforms to the program. This extension will hopefully give Congress the additional time to work out those reforms and improvements, and I will provide updates on future developments. 
 
I-81 Bill Signing - On Friday, June 7th, Governor Northam held a ceremonial bill signing for two bills pertaining to improvements for I-81 at VDOT's Salem district office.  
 
One bill is to continue studying needed improvements to I-81 and the other bill will put into place funding mechanisms to help start providing funds for the much-needed improvements to this corridor. These needed improvements will help increase the economic opportunities of this region and the state, and will hopefully increase the safety on this heavily travelled corridor. 
 
Roanoke County Raises BPOL Tax Threshold -- At the May 28th Roanoke County Board of Supervisor's (BOS) meeting, the Supervisors raised the Business, Professional, and Occupational License (BPOL) tax threshold of annual gross receipts from $125,000 to $135,000. Entities (including real estate agents in Roanoke County) with gross receipts below the new $135,000 threshold will only be levied a $50 fee. This ordinance will take effect July 1, 2019. This is good news for Roanoke County real estate agents. As part of the 2018-2019 budget, the BOS had already increased the threshold from $100,000 to the current $125,000 amount.

May Home Salesfeb    
The 609 homes sold in May represent a 6% increase over April sales and is the highest monthly total of homes sold since June, 2006. A link to the May home sales statistics, including a 4-year comparison, is provided on the front page of RVAR.com. The MLS releases its monthly home sales statistics around the 15th of the following month.
