PARTNER'S PERSPECTIVE
James O. "Joby" Birr - The Importance of Quality Time

Greetings.

These last few months have been challenging to spend time with family members, friends, and clients. Though we’ve developed new ways of staying in touch with these folks, through virtual meetings and happy hours, nothing beats the real thing of an in-person lunch, dinner or special event with those you care about.

I was reminded of the importance of quality “in person” time when I recently traveled to Tampa, with my 10-year old son, to meet some friends. The road trip back and forth from Tampa was great because my son and I were able to spend quality time together, discussing the various counties we traveled through and the sights we passed.

Once we arrived in Tampa, we shared a wonderful meal with an old friend and his family. It was amazing to see and hear how much had changed in our lives since the last time we were together. During that meal the three kids at the table were engaged in non-stop conversation. The next day my son and I went on a fishing trip in Tampa Bay, with a friend and his youngest son. That evening we cooked up the fish we caught and shared an amazing dinner with friends. Our weekend was rounded out by a wonderful lunch with yet another friend and his family. What a great weekend of in-person connection with friends!

For me, the weekend activities and social connectivity were true psyche boosters. Perhaps I am more grateful for the simple pleasure of it now because I have gone a short time without due to the Coronavirus, but either way, I was struck by how meaningful it was. There are libraries of research on the subject that validate my experience. Strong social connection triggers a series of biological activity that strengthens our immune system, lowers anxiety, disrupts depression, improves self-esteem, and effectuates a host of other positive health outcomes. The point is, good social connection and quality time can extend our lives and the lives of those we care about. The lack thereof can lead to a number of health and social ills.

With or without a health pandemic creating distance, our world is already growing increasingly impersonal. Could it be that as we blaze forward along the trail of rapidly advancing technology that we slowly draw nearer to a time when we all complacently live in our own isolation – choosing only to interact with others from behind our illuminated screens? Don’t get me wrong, I think technology is a great thing and I use it daily, but, like many of you, when I was forced to adopt it as a substitute for in person connection and quality time, it just didn’t hit the spot.

Though in-person meetings and resuming social activity as normal may not be advisable for everyone at this point, from someone who took part in a small group activity, in a way that was safe for my family, I can tell you it was awesome to reconnect with friends that we had not seen for months. If you are feeling disconnected and a bit out of sorts from the social distancing, I hope you are looking forward to a time when the dust settles and we can all get back to engaging with one another in more meaningful and impactful ways. Once we can, I have to imagine we will all embrace the opportunities to see one another and spend time together with much more enthusiasm and appreciation. I know I will.
Very truly yours,
James O. "Joby" Birr, III

Lenders should make a good faith effort to work with delinquent borrowers to bring their Small Business Administration (“SBA”) loans current. However, when a default cannot be cured, and the 7(a) loan is transferred into liquidation status, the lender becomes responsible for liquidating the entire debt owed. Although the lender has unilateral authority to take all necessary actions to liquidate 7(a) loans in their portfolio, some liquidation actions require the SBA’s written pre-approval before the lender can take action ...

At first blush, one may conclude that condominium associations and homeowners’ associations would have the same or nearly identical requirements for when turnover occurs. However, the truth is quite opposite. Florida condominium association are governed by Section 718, Florida Statutes compared to Florida homeowners’ associations, which are governed by Section 720, Florida Statutes. With that being said, Chapter 718 is more rigid on Condominium Associations compared to the statutory requirements for Homeowners’ Associations under Chapter 720 and imposes different time periods for when turnover of a Condominium Association may occur...
