Information from KDHE about CLIA Waivers
Q: "On a webinar this morning, we were told by KDHE that a facility will have to apply for an additional waiver for the testing that HHS is providing to all facilities. What is the process for that? Almost all facilities have a CLIA Waiver that is used for INRs, glucometer testing, etc. Will we be required to have an additional waiver for the COVID testing?"

A: " The certificate of waiver which you have will cover the COVID testing as long as it is up to date. We do need an email stating that you are starting COVID testing and the estimated annual volume when you are ready to go live. (Email:  kdhe.clia2@ks.gov .) Also, all positive and negatives results need to KDHE Epidemiology as STATE Reportable. The two instruments are Sophia and Abbott ID now that are certified for waived testing sites.
KS Homes with Active CLIA Waivers
Does your nursing home have a current CLIA Waiver with ALL of the information updated as well? You will need to if you wish to preform basic antigen testing for COVID-19. Click here to see if CMS has you on the list.
Update from KDADS
All CMS regulated nursing homes in Kansas have had their required Infection Control survey says Commissioner Lacey Hunter. Infection Control surveyors are not over, however. Hunter reports that KDADS receives a list from CMS weekly with 3-5 nursing homes on it that will receive another Infection Control survey. How the homes are selected is not clear but likely tied to COVID-19 hot spots and past noncompliance.

HCBS Settings Final Rule Deadline Extension
The Centers for Medicare and Medicaid Services (CMS) announced a one-year extension for states to come into compliance with the HCBS Settings Final Rule. With this extension, Kansas and HCBS providers now have until  March 17, 2023 , to come into compliance with the HCBS Settings Final Rule.

KDADS intends to use this one-year extension to allow providers additional time to remediate and come into compliance with the requirements of the Final Rule. KDADS will continue to process self-assessment desk reviews and send out notifications to providers by September 1, 2020. In addition, KDADS will push back the timeline for transitioning HCBS waiver participants from settings that are unable or unwilling to come into compliance. KDADS will publish an updated timeline in the coming weeks.
