FTC Non-Competes Ban Update – No Longer Effective Sept. 4th


As noted previously by AHCA/NCAL, on April 23, 2024, the Federal Trade Commission’s (FTC’s) Final Non-Compete Rule was released and was scheduled to go into effect 120 days after publication in the Federal Register (effective September 4, 2024). 


The rule would make nearly all preexisting and future U.S. non-compete agreements with workers unenforceable, except for preexisting non-compete agreements with “senior executives.” The AHCA/NCAL summary released earlier this year on the rule can be found here.


Yesterday, a federal judge in Texas barred the FTC rule from taking effect. The U.S. District Judge said the FTC does not have the authority to ban practices it deems unfair methods of competition by adopting broad rules.

A Message from the Kansas Department of Health and Environment – Division of Public Health


First case of Candida auris detected in Kansas


Candida auris is an emerging antimicrobial-resistant yeast that was first identified in 2009 in Asia and began spreading in the United States in 2015. It can cause severe infections and spreads easily between hospitalized patients and nursing home residents.


In July 2024, the Kansas Department of Health and Environment (KDHE) was notified of a clinical case of C. auris in a non-Kansas resident admitted to a Kansas hospital. After screening potential health care contacts, one additional person has tested positive. KDHE is issuing this health alert to ensure that health care personnel are aware the transmission dynamics, risk factors, diagnostic challenges and treatment recommendations for C. auris. READ MORE

In keeping with current policy and procedures, the HCBS BI Fee-for-Service Provider Manual, HCBS FE Fee-for-Service Provider Manual, HCBS IDD Fee-for-Service Provider Manual, and the HCBS PD Fee-for-Service Provider Manual have been updated on the Provider Manuals page of the KMAP website

(added 8/16).


A standard global message has been added to alert providers. A standard RA banner message will appear on the weeks of August 19 and 26

Nursing home salaries slow their rise; admins near $136k, DONs $118k, sector’s largest survey shows


While still under siege due to departures at top administrative levels, nursing homes nonetheless have seen the huge salary rises of the pandemic years continue to moderate, according to the largest yearly US nursing home survey.


Nursing home administrators’ average salary was $135,744 in 2024 after a tempered 3.8% annual rise, while directors of nursing hit $117,754 due to a 3.75% climb. Their respective assistants saw pay rates rise slightly slower. READ MORE
