Open Meetings Act (OMA) / Open Records Act (ORA) information

Superintendents must distribute Guide to Kentucky Open Records and Open Meetings Act (PDF) and Managing Government Records (PDF), either electronically or in hard copy, to each newly elected official or elected or appointed member, (each elected school board member and each school-based decision making council member), within 60 days of the day their term of office begins. The distribution may be by electronic means.


  1. Obtain signed proof from each member that he or she received the documents.
  2. Provide each member with a copy of the Proof of Receipt.
  3. Ask each member to complete the bottom portion of the Proof of Receipt and return it to you.
  4. Maintain the Proofs of Receipt on your district’s premises as part of your district records.
  5. Return only the completed Certificate of Distribution to the Office of the Attorney General.

Regular meetings/organizational meetings

At a meeting in January, the board shall adopt a schedule of regular meetings for the calendar year, identifying the date, time and place of each meeting.


The first meeting in January shall be an organizational meeting for the purpose of electing a chairperson and vice chairperson.

Annual practices/drills

A building lockdown practice shall be implemented at least twice during each school year. At a minimum, lockdown drills are to be held during the first 30 instructional days of the school year and in January. As directed by the superintendent, the principal or other building supervisor shall document that the practice has occurred.


Severe weather/tornado and safe area evacuation drills are to be held during the first 30 instructional days of the school year and in January. Designated school primary and secondary evacuation routes are to be posted by any doorway used for evacuation.

School nutrition/physical activity forum

The district shall permit community participation in the student wellness process by holding an advertised public forum by Jan. 31 of each year, to present a plan to improve the school nutrition and physical activities in the district in accordance with KRS 158.856.

Budget planning and adoption

On or before Jan. 31, the board shall formally and publicly examine a detailed estimate of revenues and proposed expenditures by line item for the following fiscal year. On or before May 30, the board shall adopt a tentative working budget, which includes a minimum reserve of 2 percent of the total budget.

Certified employees may be appointed by the superintendent for any school year at any time after Feb. 1 preceding the beginning of the school year.

Review of achievement gap plans

By Feb. 1 of each year, each school-based decision making council, or the principal if there is not a council, shall, with the involvement of parents, faculty and staff, set the school’s targets for eliminating any achievement gap and submit them to the superintendent.

Each local board shall provide each school council notice of a tentative staffing and budget allocation for the coming fiscal year by March 1.

Mileage rate update


If your district reimburses for mileage at the state rate, be advised that the rate per mile effective Jan. 1 – March 31 is .44 cents per mile. This information can be reviewed quarterly via this link:
