Advance Payment of Child Tax Credit excluded from income  

As noted in 26 USC 6409, advance child tax credit payments must be excluded from tenant income calculations: "Notwithstanding any other provision of law, any refund (or advance payment with respect to a refundable credit) made to any individual under this title shall not be taken into account as income, and shall not be taken into account as resources for a period of 12 months from receipt, for purposes of determining the eligibility of such individual (or any other individual) for benefits or assistance (or the amount or extent of benefits or assistance) under any Federal program or under any State or local program financed in whole or in part with Federal funds."
Federal Eviction Moratorium lifted
The CDC’s nationwide eviction moratorium to prevent the further spread of COVID-19 expired on July 31. Rent and utility assistance is available for Kansas renters, landlords, and service providers through the Kansas Emergency Rental Assistance (KERA) program. At a current rate of $3 million per week, KERA has assisted more than 4,000 tenant households with past-due rent, utility bills, and internet assistance, granting more than $21.9 million to their landlords and service providers.

If you have tenants facing eviction due to financial hardship caused by the COVID pandemic, recoup arrears and prevent loss of income by applying for KERA.

Our new HOME/HTF Resource Guide is now available online. Guide includes information relating to HOME program laws and regulations, rent and income limits, fair housing, VAWA, and more.

HUD Multifamily Q&A Updates

Revisions as of July 29 include:

  • Clarification on what unemployment compensations should be included in tenant income calculations for HUD- assisted housing
  • Exclusion of the Advanced Child Tax Credit as income
  • Guidance on accepting Emergency Rental Assistance Program funds for Multifamily Housing tenants.
