Compliance Update | August 2023

NSPIRE Final Rule


HUD published the National Standards for the Physical Inspection of Real Estate (NSPIRE) Final Rule in the Federal Register. The final rule makes changes to inspections in response to public comments.


Under NSPIRE, non-scoring deficiencies has been expanded to include:

  • Missing handrails
  • Call for aid cords
  • Carbon Monoxide detectors
  • Smoke alarms


While these items are not scored, deficiencies cited must still be corrected within the applicable timeframe.


Further, HUD has added a new “Affirmative Standards” section. These new standards include the following:


  • Guardrails
  • GFCIs
  • Fire doors
  • Minimum heating requirements
  • Interior lighting standards
  • Minimum electric outlet standards


Until October 2024, deficiencies in this category will not be scored, but will be cited and are to be corrected. 


The implementation date is October 1, 2023 for Housing Choice Voucher, Project-based Vouchers and Multifamily Housing. Read the latest notice for full details.

If you plan to attend compliance sessions presented by U.S. Housing Consultants, you must pre-order your compliance training manual for $50 during the conference registration process by Tuesday, Aug. 1.



You will receive your manual at the conference registration desk during check-in. Training materials will NOT be available for purchase at the conference.




If you have already registered for the conference and did not yet purchase compliance training materials, please follow these steps:


  1. Visit our Kansas Housing Conference website.
  2. Click the Already Registered? link beneath the "Register Now" button.
  3. Enter your email address and the confirmation number you received when you registered. Click the Forgot your confirmation number? link below that field if you need your confirmation number emailed to you again.
  4. Scroll down to the bottom of the page and click the Modify Registration button.
  5. Click Next until you get to the "Additional Items" page and select "1" under the compliance materials question, and click Next.
  6. Click Next to review your summary and click Submit!
  7. Pay the $50 fee for compliance materials.
  8. You’ll receive an automated email summary of your selections. You can always log back in to modify the sessions you’d like to attend

Tuesday, Aug. 22:


9:00 a.m.-10:30 a.m. | Calculating Income


In this content-packed, 90-minute session, US Housing Consultants will review and examine how to handle processing income types for multiple programs, including the LIHTC program, RD, and HUD. This session will provide a comprehensive review of the wonderful world of income along with knowledge checks throughout the session to provide extra guidance.


10:45 a.m.-12:15 p.m. | Calculating Assets


In this content-packed, 90-minute session, US Housing Consultants will examine the handling of assets for multiple programs, including the LIHTC program, RD, and HUD. This session will provide a comprehensive review of the wonderful world of assets along with knowledge checks throughout the session to provide extra guidance.


1:45-3:15 p.m. | HUD Deductions


Depending on the housing program, managers may have to determine a household's adjusted income, as it can affect the rent portion. In this 90-minute session, US Housing Consultants will review and examine how deductions are calculated.


3:30-5:00 p.m. | HUD Rent Calculation


Which is greater--the adjusted income or the gross? How do we factor those amounts into the household's rent? Once management determines the annual income and factors in the adjusted gross income, it is time to determine the household's rent. Join US Housing Consultants as they review how to calculate rent according to the HUD Handbook 4350.3, Chapter 5. This session will provide a comprehensive review of determining rent, along with knowledge checks throughout the session to provide extra guidance.

Understanding HOTMA's Impact on Major Affordable Housing Programs


HUD's Final Rule on HOTMA results in massive changes in how we determine household eligibility. While this is a HUD rule, it is critical to understand that HOTMA does not only affect HUD programs, it has a major impact on other affordable housing programs as well.

1:45-3:15 p.m. | The Not-So-Average Income Averaging Set-Aside


The income averaging minimum set-aside election has provided a new approach to the Low Income Housing Tax Credit program. In this course, we break down this change to Section 42 of the IRC in an end format. We highlight the benefits and potential challenges that owners may face when making this important election.


3:30-5:00 p.m. | New Income and Assets in Today's Tech-Driven Economy


We will discuss the challenges of “new income.” Learn how to calculate and verify gig income, crypto, and peer-to-peer payment apps.

Mr. Gary Kirkman has acquired over 16 years of valuable leadership experience within the affordable housing industry and now serves as the Director of Compliance Training for US Housing Consultants. Having started in the industry as a Regional Property Manager, Mr. Kirkman managed Rural Development and HUD properties before being promoted to Training Specialist, where he was responsible for overseeing multiple affordable communities while training personnel on the affordable housing programs.

As Vice President of Training and Compliance Policy, Amanda Lee Gross brings her vast experience in affordable housing to our training and compliance services. She learned the affordable housing industry from the ground up, starting as a site manager and quickly working her way to a Compliance Director. Ms. Gross has leveraged that experience and became a nationally recognized expert trainer in Fair Housing, LIHTC, RD, HUD, and HOME. She has conducted hundreds of training workshops and seminars throughout the country, helping property management professionals become more effective and better able to protect the assets and reputation of companies.

Take the 2023 Multifamily Energy and Water Survey by the Aug. 31 deadline


The U.S. Environmental Protection Agency (EPA) and Bright Power are working with Fannie Mae to conduct a national survey to update the ENERGY STAR® 1-100 energy performance score and EPA’s Water Score for multifamily properties and to better understand MF property energy and water performance to assist benchmarking and other analysis.
