HOTMA Update

 

On February 28, 2024, HUD's Office of Multifamily Housing Programs published Housing Notice 2024-04 Revised Compliance Date: Updates to Tenant Selection Plan (TSP) and Enterprise Income Verification (EIV) Policies and Procedures. This notice extends the HOTMA deadline for owners to update their TSP and EIV policies from March 31, 2024, to May 31, 2024.


 

For information regarding HOTMA required updates for the TSP and EIV policies, please reference Housing Notice 2023-10 Implementation Guidance: Sections 102 and 104 of the Housing Opportunity Through Modernization Act of 2016 (HOTMA) and the “Multifamily Housing Programs List of Discretionary Policies to Implement HOTMA” found on HUD's HOTMA resources page to ensure compliance with HUD’s new regulations.


 

PLEASE NOTE: Owners must continue to follow their existing Tenant Selection Plans and EIV policies & procedures until the Owner’s software is compliant with the TRACS 203A update. HUD is currently finalizing the specifications for the TRACS 203A update.

Note: HUD published revised FY 2024 MTSP Income Limits Tables on April 22, 2024 to correct the 2024 HERA Limit Type and resulting HERA Special Limits for 44 areas. For Kansas, this revision only impacted Kingman County.

Physical Inspection Reminders!

  • All tenants must receive advanced, written notice informing them their unit may be selected for KHRC’s inspection. Providing less than 24 hours' notice or verbal notice is not sufficient.


  • Prior to the start of the inspection, a copy of the written notice must be available for review by KHRC. 



  • The inspection will be rescheduled if:
  • Proper notice was not given;
  • A property representative is not present; and/or
  • Inspectable areas are not accessible.




Additionally, the owner/agents may be subject to a violation fee as covered in Chapter 18 of the 2024 Compliance Policies and Procedures Manual if they are not properly prepared for KHRC physical inspections.
