Kelly's Update

First Things First

This was a particularly challenging deadline week and I’ll get to the bills that have made it through this first hurdle in a minute, but first I want to provide an update on a bill that was never even requested for a hearing but became an issue this week. In February, the ACLU approached me to share that they were starting to work on examining ways to regulate the use of biometric technology in law enforcement operations, largely based on reports of abuses during immigration surges here and in Minnesota, where lawmakers and activists reported multiple instances where ICE agents abused private data to harass activists and lawmakers. Additionally, despite reliance on our biometric identifiers, technologies like facial recognition are inaccurate. In a 2018 study titled Gender Shades, the error rate for light-skinned men was .8% compared to 35% for darker-skinned women. That same year the ACLU of Northern California conducted a test from a major facial recognition vendor that incorrectly matched 28 members of Congress with other people who have been arrested for crimes. Since then, additional testing by NIST and academic researchers indicates that these problems persist.

They asked if I’d introduce a bill that could serve as a jumping off point for long term discussions with stakeholders about how these technologies can be utilized for legitimate law enforcement activities while protecting data privacy and preventing abusive practices. HB5521 was never expected to move as introduced this session, and we anticipated amendments resulting from engaging with stakeholders across the political and policy spectrum outside the pressure cooker of session deadlines. It’s a pretty common practice to introduce bills that are jumping off points for deeper discussion and negotiations and can be an effective way to guide deeper policy dives. There was another bill this year that also contemplated an area where technology and the law are still being figured out that was heard in committee this week and voted down. That bill examines an emerging area of the law concerning neural data privacy. The debate was intense, with significant disagreement on everything from what constitutes neural data, who might be collecting it, what kinds of penalties might be involved, who would be responsible for enforcement, you name it. The bill was voted down with 3 votes in favor and 10 votes opposed, likely ending any meaningful conversation on the issue before it even started. While the timing of the reaction to HB5521 was obviously horrible and served to fan the flames of media outlets engaging in a feeding frenzy over a tragic murder in our community, this was not a proposal that was intended to be considered for a vote at this time. Friday, the bill as introduced returned to the Rules Committee where it will remain, but the conversations to contemplate how and when to use these technological tools and what safeguards need to be in place should still happen.

The Rest of The Story

Friday was the deadline to get bills out of committee in the House, and last week was the first time that both chambers had been in session at the same time in four weeks. That combination was a lot. There were so many constituent groups in town because lobby days really only make sense when you can connect participants with both their Representative and Senator, but with our deeply dysfunctional session calendar this year, that means that there are only a handful of days available for groups to plan visits where there’s a chance of seeing both chambers. Add in the volatility of a deadline week where committees run extra long, extra meetings are added on short notice, and members need to be in multiple places at once - both sitting on their assigned committees and in other committee rooms to present their bills, and it’s a pretty frustrating experience for everyone. We did our best to make sure everyone at least saw Taylor or Mike and huddled up each day to go over what bills folks had come to advocate for, but I’m sure we missed some folks who had hoped to connect. That said, I was pleased to have a bonus experience when I was asked to substitute into the Appropriations: Human Services Committee to cover for another member who had to go to another committee and had the pleasure of hearing testimony from two residents of the 14th district: Jim Bennett, who leads the state’s Department of Human Rights and Anne Igoe, who was presenting a bill on behalf of Service Employees International Union: Health Care. It was fun to give them and our amazing community a shout out.

Bills I am sponsoring that passed before the committee deadline include:

HB4075 - Name Change Procedure: This is a trailer bill to the law easing the path for legal name change for transgender people and survivors of gender based violence and human trafficking who have criminal convictions in their past. Illinois has among the most restrictive laws in the country as it relates to folks with any criminal history. The law we passed in 2023 contemplated the importance of balancing public safety with the threat to personal safety that comes from not having your documents match your identity and did that by reiterating that anyone on a registry was required to update their registration immediately and allowing prosecutors discretion to seek additional information in certain cases. In some cases, this was misinterpreted as a requirement that anyone with any criminal history anywhere needed to submit to fingerprinting, a process that can significantly delay someone’s proceedings, increase already prohibitive costs on those with the least capacity to absorb them, and result in errors. In the vast majority of jurisdictions in Illinois, these cases were being handled appropriately and only folks with more recent or more serious criminal cases were being impacted, but there were still significant numbers of cases being delayed. Passage of HB4075 will allow those who need matching documents to proceed through the process and ensure appropriate history information is being collected from petitioners. The bill will likely be amended one more time once we complete discussions with the Cook County State’s Attorney’s Office and Illinois State Police to ensure that procedural language is workable.

HB4255 - Traveling Animal Acts: This bill will expand Illinois’ historic ban on using elephants in traveling entertainment exhibits to cover bears, primates, and most big cats. This bill is an initiative of Humane World for Animals, which partnered with Lincoln Park Zoo and Brookfield Zoo to craft the bill. There is an amendment pending that clarifies specific species of large cats that can still be included in traveling exhibits such as Zoo based “animal ambassador” programs as long as those programs still comply with federal law concerning animal and spectator safety.

HB4428 - Court Reminder Notices: In the wake of the successful implementation of the Pre-trial Fairness Act that established that risk rather than wealth determined the outcome of pretrial detention proceedings, several jurisdictions have taken on programs to provide text message reminders to people awaiting trial. Academic studies of various pretrial support programs have found this very simple and cost effective procedure greatly improves attendance and reduces the number of failure to appear warrants a jurisdiction has to issue and execute. In exploring the issue, we found significant variation among the various jurisdictions operating programs as well as some that were not doing it at all. Working with the Illinois Supreme Court’s Office of Statewide Pretrial Services, we are proposing a combination of changes that will streamline the process and gather data on the various approaches being taken across the state in order to identify and elevate best practices.

HB4826 - IDFPR Continuing Education: Illinois is one of a very small number of states that does not do its own reviews of continuing professional education materials or curricula, instead authorizing professional organizations to certify trainings and providers. In recent years, a trend has emerged where states are discovering professional education trainings that cover topics that are not approved practices in those states. This bill would amend the statute empowering organizations to approve trainings to prohibit the approval of CPE credits for any training promoting practices that are prohibited in the state of Illinois. In testimony at a hearing this week, I shared a communication from the head of the state’s dental hygienists association about her real world experience with this issue. She shared that there are several states that allow dental hygienists to administer Botox injections, but Illinois does not. She has been asked to approve trainings for Illinois based hygienists even though they are not permitted to perform these procedures under their scope of practice. Other examples that have been shared would include seminars on creative billing practices.

HB4834 - PMP Testosterone: Last year, we passed HB5373 that limited law enforcement access to the prescription management program without a legitimate investigative purpose to prevent fishing expeditions that would target chronic pain patients as well as gender affirming care patients. This bill will take the additional step of removing testosterone from the PMP while proactively prohibiting Illinois from including gender affirming care or reproductive health medications in our PMP.

HB4839 - Fetal Death Certificate: Under the Reproductive Health Act, there were open questions regarding the proper documentation for anyone seeking formal disposition of fetal remains after a spontaneous or induced pregnancy termination. Under this initiative of the Illinois Department of Public Health, a new form will be introduced as an acceptable document to obtain a disposition permit for private disposition spontaneous miscarriage, or a fetus of any gestational age for induced termination of pregnancy.

HB4966 - Secure Act: As states around us impose ever more restrictive laws around bodily autonomy, we have to ensure that when Illinois youth are brought into our child welfare system, their rights are protected, even if they receive an out of state placement. Working closely with the Department of Children and Family Services, we are building in guardrails in the system to ensure that even if the best possible placement for a youth is in a state with laws restricting access to care, we have a plan in place to ensure that youth does not lose rights as the result of an out of state placement and codifying that youth in care do not lose the rights they have in Illinois based on where they are placed.

HB5046 - Electronic Prescriptions: Our work to try and protect access to care for chronic pain patients continues. One common experience for many patients is to have a prescription for meds only to find that their regular pharmacy does not have their medication in stock which can frequently result in a lengthy effort to secure a new prescription in order to get their needed medications. This bill would simplify the steps patients would need to take to get a replacement prescription.

HB5383 - DUI Treatment Court Act: Illinois has seen great success with specialty courts. A Republican Senate colleague introduced me to a retired judge from his area who has been working with county courts around the state to establish DUI treatment courts to steer more first time offenders into treatment. While at least six different court systems have established DUI Treatment Courts, Judge Mark Shaner has experienced pushback from counties who want the certainty that a state law authorizing a DUI Treatment Court can provide, so we’re working with the various stakeholders to ensure that existing programs can continue to operate while authorizing other communities who want to implement the program can do so effectively.

HB5411 - Rabies Vaccines in Shelters: The amazing team at the 14th district’s own Tree House Animal Shelter have been working in coalition with rescues across the area to streamline intake procedures to ensure that rescued animals can get their needed vaccinations while shelters struggle with a nationwide shortage of veterinarians. We continue to work with the Illinois State Veterinary Medical Association to try and balance the need to ensure proper care for pets while also ensuring proper protocols are followed to protect public health.

HB5468 - CESSA Trailer: In 2021, Senator Robert Peters and I passed the Community Emergency Service and Safety Act (CESSA) that will eventually result in a system-wide mental health first responder model when someone calls 911 or 988 for a mental health emergency. As this new law represented a massive overhaul of our emergency response system, it has required regular updates to ensure that stakeholders can maintain timelines and establish appropriate procedures.

Holiday Stuff

We are out of session this week for the Passover and Easter Holidays. I’m looking forward to a visit with my big brother who is joining us in Ann Arbor to visit our youngest on campus, but we’re also squeezing in some bill negotiating sessions so we keep the momentum going as we head back and begin floor action on our bills. We also expect to have a bill limit instituted at some point, so some of these bills might also become summer projects in the weeks ahead if we’re not able to get to final language shortly.

There’s a lot going on in the area this weekend. I’m sorry to miss the Transgender Day of Visibility Rally on Saturday April 4th at 1pm at Federal Daley Plaza. We always have a ball at R Public House’s Annual Easter Brunch and Easter Egg Hunt but will still be in Ann Arbor, so that just means more eggs for neighbors to find. However you spend this spring weekend (I planted kale, carrots, and basil yesterday!), be safe and be kind to each other.
