Kelly's Update

Happy no more campaign commercials for at least a month or two eve everyone! Make your plan to vote before 7pm on Tuesday, and if you have a mail in ballot that you have not already sent, it’s crucial that your ballot be hand delivered to a polling place or early voting site.

There will be no long election night partying for me Tuesday night as we have session on Wednesday and I hate the early morning drive bad enough when I’ve had a full night’s sleep. We’ve got just a handful of session days before the deadline to move bills out of committees on March 27th. I have a few bills that are assigned to committee, some of which are close to completed negotiations, so I expect to move a couple of bills this week or next. I’m hopeful that we’ll see another batch of bills assigned to committee from Rules soon as the bulk of my bills have yet to be assigned, which doesn’t bode well for the impending deadline. While a lot of bills are posted to committees this week, it’s not a guarantee that every bill will be heard in this week’s hearing. There are a lot of factors that play into committee chairs’ decisions about when bills will be heard including availability of witnesses, stage of negotiations, overall committee hearing load, among others. Most committee chairs try to make it known which bills will be heard as soon as is practical before a hearing, but again there are often moving parts that can’t be predicted that can impact a day’s call list. By and large, chairs will do everything they can to accommodate witness’ travel schedules above all else.

Here are a couple things that might move this week:

HB4075 is a clean up bill to address implementation issues discovered since the law allowing people with certain criminal backgrounds access to legal name change under certain conditions. Illinois has long been among the most restrictive states with regard to name changes for people with criminal histories in spite of the fact that existing name change law already makes it nearly impossible to change one’s name to avoid criminal responsibility (your fingerprints and social security number don’t change, registry laws already require folks to update their registry).

We’re in the middle of a life or death crisis for transgender people who desperately need their identity documents to match their appearance. When we first passed the law in 2023, things were already getting bad and it felt urgent then. But now it’s a five alarm fire, with states around us literally invalidating drivers licenses and birth certificates without notice. Since implementation, in most parts of the state, our law’s implementation has been smooth, but in Cook County, folks are being subjected to costly demands and delays based on a misinterpretation of the law. A person with no Illinois record who discloses a long ago charge in another state will likely be forced to spend additional money and likely several case continuances to seek an “update” to an Illinois criminal record that does not exist. Each step brings more time where a person’s documents do not match their identity, more expense, more exposure to potential harm, and more doubt in a system that should exist to support all of us.

HB4075 is assigned to the Judiciary-Civil Law Committee and is posted for this week’s hearing on Thursday. We’ve made good progress with the Cook County State’s Attorney’s Office and are hopeful we will have an amendment shortly that will address questions about implementation.

HB4255 is an initiative of Humane World for Animals and the Lincoln Park Zoo and would add big cats, primates, and bears to our state’s groundbreaking law prohibiting the use of elephants in traveling exhibitions. I’ve learned a lot working with these advocates and The Brookfield Zoo, whose animal ambassador program sought some exemptions to the prohibitions to better address their educational goals. The bill is posted to the Judiciary-Criminal Law Committee for a Wednesday hearing.

HB4428 is an initiative of The Alliance for Safety and Justice, a criminal justice reform organization that centers the stories and needs of victims and survivors of violent crimes. Studies around the world have shown that one of the simplest ways to ensure defendants appear for scheduled court dates while on pre-trial release is to provide a simple reminder via text message. Since the implementation of our state’s Pre Trial Fairness Act, most of our courts have adopted some version of this, with variations around who implements it and whether the defendant opts in or opts out of the alerts among other minor variations. If enacted, HB4428 will mandate uniform notification that defendants have the ability to opt out of if desired. That simple change, from being asked to opt in or out, makes a huge difference in studies of similar programs on their ability to impact court no show rates. HB4428 is also assigned to the Judiciary-Criminal Committee.

HB4652 has gotten a fair bit of attention lately as it reflects a policy that students in Pontiac, Illinois identified as a policy that could impact the environment and individual health by mandating that all retailers selling any vape product make available environmentally responsible collection and disposal of the countless batteries that currently end up in landfills. We continue to engage in discussions with various stakeholders on this bill and hope to continue the discussions throughout the session. This is one of those policies that makes too much sense in so many ways, but really has a much broader impact than you might initially consider. We’ve had discussions with the Illinois EPA and the Attorney General’s Office and have heard from folks from retail and manufacturing as well as the cannabis industry. In most cases, the conversations center around agreement on the need to solve the obvious environmental problem caused by these batteries with questions about how each stakeholder is going to be impacted by the law. This bill has been posted to the Executive Committee, which doesn’t necessarily follow the same calendar as the rest of the body as it’s where more complex bills often get worked on.

Sunday afternoon, I broke my self imposed rule of not going out to bars to celebrate St. Patrick’s Day by joining neighbors at Protect RP’s Irish Songs of Resistance at Jarvis Square Tavern. I grew up on Irish protest songs, so of course I wanted to be there. I had fun chatting with folks about the songs, and when I was given the chance to say something to the crowd, I talked about the importance and power of art in resistance movements and urged the crowd to tip the musicians to show our support for their work.

I hope you’ve already voted, or already have your plan to vote. I really love going to vote with my kids, or whatever assortment of them I can anyway. Remember, city of Chicago voters can vote at any early voting location in the city today and polls open on Tuesday from 6am to 7pm.

Cyrano

Cyrano

By Michael Dalberg

Directed by Tony Lawry

March 13-April 12

In this Original TATL adaptation by Michael Dalberg (Grimm, The Blood Countess, The Strange Case of Dr. Jekyll and Mr. Hyde) Cyrano cannot share her love to the multi-courted Roxanne. Thus, she speaks her truth through dim witted Christian, Roxanne’s true desire. In a romantically comical retelling of the classic, body image, self-doubt and misogyny are central themes. With some food fights along the way you’ll see that sometimes love is right in front of your nose!

Performances are Fridays and Saturdays at 7:30pm and Sundays at 3pm at the Jarvis Square Theater located at 1439 W. Jarvis. Please visit theatreatl.org for tickets.

Use the Rogers Park coupon code unclecardinal at checkout for $10 OFF THE REGULAR $25 ticket price. Subject to availability, not valid opening or closing weekends.

Rent

Rent

Directed by DeRon Williams

Book, Music and Lyrics by Jonathan Larson

March 26 - April 12

Newhart Family Theatre

Lower East Side of New York City. End of the millennium. Mark and Roger are roommates, and they can’t afford rent (again). But they don’t let that stop them from enjoying life while they can. They find solace in their community of fellow artists and activists who are also trying to make ends meet as they struggle through life, love, their art, the AIDS crisis, and paying (or not paying) rent. Jonathan Larson’s final musical still resonates today about the importance of trying to get your voice heard, even if it seems no one is listening.

Tickets can be purchased here.
