Federal Level
In response to the COVID-19 outbreak, the Trump administration has declared a
State of National Emergency
. This declaration makes available $42 billion from the Federal Emergency Management Agency's disaster fund to various state governments.
President Donald Trump has also announced
new guidelines
which limit gatherings to 10 people or less for the next 15 days.
On March 17, the Trump administration has proposed a
$850 billion stimulus package
to provide relief for small businesses and the airlines industry.
The U.S. House of Representatives has voted to pass a legislative response package called the Families First Coronavirus Response Act (H.R. 6201). The bill would do the following:
- Give state governments more flexibility in allowing Unemployment Compensation to employees affected by the outbreak;
- Require government employers and private sector employers with less than 500 employees to provide two-weeks of sick paid leave to employees impacted by the outbreak;
- With certain exceptions, these same employers would be required to provide 12 weeks of paid family or medical leave to employees who have been employed for at least 30 days and are impacted by the outbreak;
- Require private health plans, Medicare, Medicaid, TRICARE, Veterans programs, Indian Health Services to provide coverage for free diagnostic testing; and
- Provide $1 billion to reimburse the cost of diagnostic testing for individuals without health insurance.

State Level
The California State Legislature has voted to adjourn and recess from March 20 to April 13, though dates may be subject to change.
Governor Gavin Newsom signed an
Executive Order
on March 13 guaranteeing state funding for schools that are temporarily closed in response to the outbreak. With this funding, school districts are required to continue providing educational opportunities through distance learning and independent study; provide school meals; arrange supervision for students during ordinary school hours; and continue to pay school employees.
On March 16, Governor Newsom issued an
Executive Order
which halts evictions for renters and homeowners, places a moratorium on foreclosures, and implements consumer protections against utility shut-offs.
The Governor's office is working closely with the Labor & Workforce Development Agency to facilitate the provision of paid family leave, Disability Insurance, paid sick leave and workers' compensation benefits for employees impacted by the outbreak.
The Governor has recommended seniors to self-isolate, and bars and pubs to close their businesses to help slow the spread of COVID-19.
Yesterday, the California State Legislature passed two bills, Senate Bills 89 and 117, in response to the COVID-19 outbreak. SB 89 frees up $1 billion from the General Fund to carry out any purpose related to the Governor's proclamation of a state of emergency. SB 117 makes $100 million from the General Fund available to aid local educational agencies during the state of emergency.
Local Level
On March 15, Mayor Eric Garcetti issued an
emergency order
to temporarily close all bars, nightclubs, movie theaters, entertainment venues, bowling alleys, arcades, gyms and fitness centers in the City of Los Angeles until March 31. In addition, restaurants are prohibited from serving food to dine-in customers. The Mayor has ordered a moratorium on evictions during this local emergency period if the tenant can verify an inability to pay rent because of circumstances related to the COVID-19 outbreak.
On March 16, Mayor Garcetti
relaxed
parking enforcement for the next two weeks with a possible extension to three weeks.
Six counties in the San Francisco Bay Area announced a shelter-in directive, requiring virtually all businesses to close and residents to remain at home. VICA recommends to stay alert if similar measures are taken by Los Angeles City or County officials.

Many employers face a significant number of employee leaves of absence and employment terminations related to COVID-19. This article provides some clarity about how to handle benefit eligibility. Over the next several weeks, additional guidance and clarification from federal and state government agencies is expected, perhaps providing some exceptions and requirements regarding benefit eligibility. However, there are some general guidelines that we can follow in the meantime.
Sick Leave
It is necessary to consider whether FMLA-protected leave applies for employees who request leave due to their own COVID-19-related illness or to care for a sick family affected by COVID-19.
