Former president on trial

As Donald Trump's "hush money" trial played out, news outlets turned to LBKM's former prosecutors for their insight.

Adam Kaufmann was on the scene with CNN on day 1 of the trial and later discussed the verdict on NBC News.

At the outset, John Moscow noted the slim odds of acquittal in Law360, and later commented in RawStory on the upcoming sentencing in light of the recent SCOTUS decision holding that Trump is immune from prosecution for official acts taken while in office.

Marc F. Scholl was quoted in the New York Times and Law360 on the opening arguments of the prosecution and the defense, as well as the instructions given to the jury—including why the jury can't have them in writing.

Anthony Capozzolo appeared on the Canadian Broadcasting Corporation to discuss the impact of Trump's conviction on all counts.

Eric Lewis advises Assange UK defense team; Assange wins right to appeal against extradition to US

Prior to accepting a plea deal in June, Julian Assange won a crucial victory that postponed his extradition to the United States. Two English High Court judges ruled they would allow a full appeal to be heard because questions remained as to whether Assange, as an Australian citizen, would be permitted to assert First Amendment rights in the US trial.

Eric Lewis advised Assange's UK defense team with respect to the law and procedure of foreign nationals asserting rights under the First Amendment as a defense in criminal trials. [Read more]

Abu Zubaydah v. Mitchell and Jessen

LBKM continues to represent Abu Zubaydah, the longest-serving prisoner in Guantanamo Bay, in seeking to hold accountable the CIA contractors responsible for his torture. In June, the team (which includes Eric Lewis, Solomon Shinerock, Alex Bedrosyan, David Short, Annika Conrad, and Li Jiang) filed Mr. Zubaydah’s appellant brief in the Ninth Circuit Court of Appeals seeking reversal of the lower court’s findings concerning the defendants’ alleged immunity under the Military Commissions Act and derivative sovereign immunity, the political question doctrine, and the scope of the Alien Tort Statute. Chiara Spector-Naranjo was a panelist for a segment on third-party liabilities in the context of fraud and insolvency at the Asset Recovery Americas Conference, also in Washington DC. In May, Carol Van Cleef spoke at a town hall forum in Austin on Where and Why Crypto is Thriving, and Cristián Francos co-moderated a panel on subsidies fraud post-Covid-19 at the International Bar Association's 26th Annual Transnational Crime Conference in Milan.
