Department of Health Revises Travel Advisory for Asymptomatic Individuals Traveling to NY
The NYS DOH recently published new travel guidelines for individuals traveling to New York from another state or country. According to the new advisory, asymptomatic travelers entering New York from another country, U.S. state, or territory are no longer required to test or quarantine as of April 10, 2021. 
 
NYSAR has revised and renamed the “COVID-19 HEALTH SCREENING & TRAVEL ADVISORY QUESTIONNAIRE” which is now called the “COVID-19 HEALTH SCREENING QUESTIONNAIRE”. Any reference to quarantine and testing has been removed from the new form. A copy of the form can be found here. Applications for 2022 Board Officer - Deadline Approaching
LIBOR’s Credential Review Committee will meet soon to review all candidate applications for the 2022 officer positions to be elected by the Board of Directors, and the 2022/2023 director positions to be elected by LIBOR membership, in order to confirm that each candidate meets the minimum criteria set forth in the LIBOR Bylaws and Policy and Procedures Manual.

If you would like to seek election as an officer or director and have the Credential Review Committee review your application, you must complete the respective application form and return it to LIBOR no later than April 30, 2021 for officer positions and August 9, 2021 for director positions. Judge Overturns State Guidance to Allow Broker Fees on Rentals
On April 9, the Supreme Court of the State of New York published the decision in the lawsuit NYSAR and others filed against the Department of State (DOS) in February 2020. The court ruled in favor of NYSAR’s position that the Tenant Protection Act (TPA) of 2019 does not apply to a landlord’s agent being paid commission by a tenant. As such, a landlord’s agent may continue to collect commissions from the tenant. Learn more.
    
New York House Delegation Urges White House to Repeal SALT Deduction Cap
On Tuesday, Democrats in New York’s House delegation sent a letter to House leaders urging for the repeal of the $10,000 cap on state and local tax (SALT) deductions as negotiations with the White House over President Joe Biden’s infrastructure package continue. In the letter, House Democrats say they will oppose any tax legislation that does not fully restore the SALT deduction.
 
NAR Opposes DOL Independent Contractor Action
NAR submitted comment opposing the Department of Labor’s proposed withdraw of the final rule on independent contractor status under the Fair Labor Standards Act (FLSA). NAR continues to resist any efforts by federal regulators or legislators that threatens real estate professionals’ ability to classify as an independent contractor. Additionally, NYSAR continues to engage state lawmakers to protect independent contractor status for real estate licensees at the state level.
