So why is this important to LPTV and TV translators? Because for over 1100 days now we have been left out of a process which the FCC had the discretion to include us in. They have not studied how LPTV and TV translators could impact the auction, or be impacted by it. We have been denied an audience with three Chairman in a row, with the current Chair denying our industry five times now. We were the only stakeholders denied an official on-the-record LEARN session before the Incentive Auction rule making was made, thereby cutting off all of our input into the process in an open forum. The Chairman has squelched debate on amending our rules, which in and of itself is contrary to the Incentive Auction legislation. And he is holding the item up on circulation in the Commissioner's office so that we can not have meetings with the Commissioners about it. The FCC has denied basic procedures to our industry in violation of the Administrative
Procedures Act., so much so that last week we learned that they hold private meetings on government property between selected sellers and buyers in the Incentive Auction and fail to disclosure in detail according to their own ex parte rules. It will be the FCC itself which will be pushing LPTV and TV translators into the courts!

As the LP1 for the (Oregon) Capitol Operational area there is indeed a vital need for us. We are not only the LP1,
but since Salem does not have a TV news presence at this point, we have a system in place that allows the PIO's to directly take over our TV channels and give information directly to the public and additionally to the Portland and Eugene markets and their news groups. When we are in an emergency it is vital that we can get to the designated PIO location and transmitter to keep this system working, Thanks to the OAB and Bill for making this happen."
So in this case, an LPTV station, which can be displaced by the Incentive Auction, is serving a VITAL role as a support station for First Informers...nice going Ken and Mike!
