GRAY TELEVISION SUBMITS PROPOSAL TO FCC TO ESTABLISH NEW CLASS-A WINDOW FOR PRIORITY PROTECTIONS IN POST-AUCTION REPACKING

Coalition seeks to understand how this proposal would affect you and your LPTV operations and investment.  With many major market LPTV stations under multi-year contracts for channel leasing, establishing and operating as a Class-A would be very hard to do by the end of 2015.  And do we want to pit one LPTV vs another as to which has the most relevant content in the public interest?  Please review and take our quick survey so we can better understand your opinion.

COALITION OPINION:
We welcome this initiative from Gray TV since it shows that one of the major LPTV licensee, and the one with what is surely the largest number of big four network affiliates, is thinking of how to continue their public service obligations post-auction. Hats off to them for that.  One of the big secrets in the Incentive Auction process is that there will be a tremendous loss of broadcast television public service obligations due to the loss of many ethnic and independent stations.

While we oppose any proposal which enriches one LPTV party over the other, or which disadvantages one over the other, we certainly are open to learning more, and that is why we need you to take the survey.  The proposal (and that of DTV America) are well reasoned, have a sound legal basis, but could be viewed as self-serving - but heck, so is this newsletter!

Somewhere in this conversation is a solution for getting all LPTV channels in the repack, and earning a sense of permanence. Many of us have been tossing in the wind at the mercy of the legislative and rule making process far too long.  But we need to be careful in how this type of proposal could effect all LPTV being found channels in the repack by the FCC.  We need to avoid a scenario that the folks with the biggest checkbooks, and fastest filing engineers win the day.  This should not be a race or free-for-all for spectrum grabbing, nor a Black Friday sale at the local shopping mall.  Which we do not think the Gray TV or DTV America proposals are.  We just want to make sure the next displacement is our last one for a while so we can get back to building a business.

The FCC has already said they intend on an orderly process of first conducting an LPTV optimization modeling to assign us all channels, and then allow us to modify. Let's make it happen in a way that we all win, and there are no losers, no matter what your content is.

Spectrum licenses are commonly acquired not only from the Federal Communications Commission, but also from incumbent licensees in the secondary market. Such transactions, which include both spectrum sales and leases, comprise a significant part of the practice of Fletcher, Heald & Hildreth, PLC attorneys.

We assist clients in targeting potential acquisitions, negotiating purchases and sales, drafting the transaction documents, assisting in financing arrangements where needed (with special attention to unique FCC restrictions), handling the associated FCC application process, and then making closing arrangements.

COALITION MEMBERSHIP
Free Membership For All LPTV Licensees!

So how can we offer a free membership and still get all of this work done here in DC?  Well, we provide a lot of services which LPTV and TV translator licensees need from filings into the FCC proceedings, the DMA Repacking Studies, arrange contracts for carrying networks on your channels, and most importantly, we take on direct assignments for advocacy from licensees.

We also get a lot of direct support for our own specific research projects which are funded to help the entire industry.  And these have become the best of what we have been able to offer for the defense of LPTV in the Incentive Auction process.

No one interest group controls us, and we work for the best interests of the many. As LPTV licensees, operators, and investors, we know what you are going through and your challenges.  Like we say...
