GRAY TELEVISION SUBMITS PROPOSAL TO FCC TO ESTABLISH NEW CLASS-A WINDOW FOR PRIORITY PROTECTIONS IN POST-AUCTION REPACKING

COALITION OPINION:
We welcome this initiative from Gray TV since it shows that one of the major LPTV licensee, and the one with what is surely the largest number of big four network affiliates, is thinking of how to continue their public service obligations post-auction. Hats off to them for that.  One of the big secrets in the Incentive Auction process is that there will be a tremendous loss of broadcast television public service obligations due to the loss of many ethnic and independent stations.

While we oppose any proposal which enriches one LPTV party over the other, or which disadvantages one over the other, we certainly are open to learning more, and that is why we need you to take the survey.  The proposal (and that of DTV America) are well reasoned, have a sound legal basis, but could be viewed as self-serving - but heck, so is this newsletter!  

Somewhere in this conversation is a solution for getting all LPTV channels in the repack, and earning a sense of permanence. Many of us have been tossing in the wind at the mercy of the legislative and rule making process far too long.  But we need to be careful in how this type of proposal could effect all LPTV being found channels in the repack by the FCC.  We need to avoid a scenario that the folks with the biggest checkbooks, and fastest filing engineers win the day.  This should not be a race or free-for-all for spectrum grabbing, nor a Black Friday sale at the local shopping mall.  Which we do not think the Gray TV or DTV America proposals are.  We just want to make sure the next displacement is our last one for a while so we can get back to building a business.

The FCC has already said they intend on an orderly process of first conducting an LPTV optimization modeling to assign us all channels, and then allow us to modify. Let's make it happen in a way that we all win, and there are no losers, no matter what your content is.
