Last week an EMERGENCY MOTION was filed by  Latina Broadcasters of Daytona Beach, LLC.  In  response,  the Court issued this schedule last Friday, and was just posted today:


So here is the schedule:

FCC has to file a response to the emergency motion by high noon this Friday, March 4th.  Latina then has to reply by 9 am Monday the 7th. And then the judges (the same ones as in the LPTV cases) will make a decision on the stay.  March Madness!

AMENDMENT OF PART 15 OF THE COMMISSION'S RULES FOR UNLICENSED WHITE SPACE DEVICES

This NPRM and Order responds to a petition submitted by NAB alleging that there are data errors in the registration records for fixed devices in the white space databases, and requesting that the Commission undertake rulemaking and other actions. (Dkt No.  RM-11745 16-56 ).   Action by:  the Commission. Adopted:  02/25/2016 by NPRM. (FCC No. 16-23).  

But if you want to read the really nasty Report & Order, see below.  It was passed last year, and spells out how TV white space and unlicensed uses are changed and permitted in the post auction repacked TV band.

What a load of carp this all is. TV White Space has been a failure with only a few devices in use, and not the HUGE new industry the FCC, Congress, and promoting industries make it out to be.  And they think it is going to get any easier or better in the repack?  No, it will get orders of magnitude harder, simply because all of the repacking LPTV and translators, never mind the thousands of outstanding new construction permits.  And that is why the FCC, at the direct request and command of MicroGoo, are attempting to approve the Vacant Channel NPRM.

COALITION COMMENTARY
Now why the heck did I just give so many column inches to the WISPs? Aren't they the folks using the TV white space?  Like, free unlicensed spectrum?  And haven't they been hassling LPTV for quite a while wanting our spectrum?  Well folks, yes to all above.  But here is the reality of the situation - we is them, and them is us.  Starting with the 1999 Digital Data Services Act (DDSA), LPTV blazed the trail to use TV spectrum for wireless internet.  It took a couple years for the rulemaking after the legislation, and by then the internet bubble had burst, 9/11 had happened, and the anticipated switch to digital TV was on the horizon. Multiple LPTV operators and new investors formed ventures for wireless internet, and in the 2009 rural filing window more than 2000 new construction permits were applied for directly related to wireless internet.  But then the National Broadband Plan came out, and the incentive auction legislation was rammed through, and all LPTV plans ground to a halt.  Internet age industrial policy slammed shut the financing.  But while this was happening, the wireless internet industry was taking off using unlicensed spectrum.  With 3000 new providers, the concept which LPTV pioneered proved itself.  Imagine now what could be done with ATSC 3.0 using an all IP transport, communications, and interactivity toolset.  We is them, and them is us.
