LVH-P has recently altered and expanded its utilization of staffing resources, citing the COVID surge, patient care needs, and need for flexibility. JNESO has reminded LVH-P that the Contract provides for many options to address staffing fluctuations and emergencies that should
be adhered to.
PULLING
Article 12.1 of your contract states:
"Nurses who are temporarily reassigned to a unit other than their primary unit shall be assigned patient care in accordance with their annual demonstrated competency level."

Please make sure you always practice within your scope!

If you are given a patient assignment outside your competency level, you have the right to refuse the assignment before accepting it.
CROSS TRAINING
LVH-P has solicited RNs to voluntary agree to be trained to work in Critical Care Units. The training provided is a modified program and is not a program of 4-6 months to become a Critical Care RN. JNESO views this as violating a number of contractual provisions, and places the RN and patients at risk. In addition, the "training" pulls the RN off her/his regular unit, leaving their unit short staffed. JNESO has filed this issue with the National Labor Relations Board as this program was not negotiated with JNESO. The NLRB deferred the issue to the Grievance & Arbitration process and we are waiting for dates for this case to be heard.

We will keep you informed.
