Breaking News- Time to Review Your Employment Agreements!
The Ontario Court of Appeal has very recently issued a landmark decision finding that an invalid ‘with cause’ provision in an employment agreement will invalidate an otherwise valid ‘without cause’ termination provision.
With the help of legal counsel, employment agreements should be reviewed and revised so as to ensure employee entitlements upon termination are limited to those under the Employment Standards Act, and not determined by the common law (i.e. potentially one week of notice or pay in lieu thereof for every year of service vs. one month of notice or pay in lieu thereof for every year of service).
