Greetings Members,
For me the holiday season is one of my favorite times of the year. The sights and sounds of the holiday always hold a special place in my heart and in my memories, and somehow seem to create a time of joy, celebration, and anticipation. It is a time to reflect on the past year while simultaneously planning for the year ahead.
As I reflect on the past year, I am especially proud of the work of the Lancaster Chamber of Commerce. We will have sponsored two fabulous parades, held community forums for our members and others to learn about important matters in our community, we have helped member businesses obtain and retain clients/customers, we have been active in making Lancaster a great place to own a business, work, and to live. I thank each of you for your contributions to our Chamber. It is each of you who make a difference to our success.
During the coming month, we'd like to feature pictures of our member businesses celebrating the holidays on our website. If you have pictures to share, please send them to Mark at the Chamber Office. This might be a time to share some community project in which your business participates, your staff working with your customers, or anything that you feel might be appropriate for the sharing.
Again, thank you for the blessing of allowing me to serve the Chamber this year. California Legalizes Marijuana Use,
But Employers Can Still Keep
Workplaces Drug Free
On Tuesday, November 6, 2016 California joined several other states in legalizing recreational use of marijuana by adults. Proposition 64, also known as the Adult Use of Marijuana Act, legalized the recreational use of marijuana for adults 21 years old and over. The provisions related to the legalization of marijuana and workplace protections took effect November 9 - the day after the election.
Legalizing marijuana for recreational use is a significant change to current law. However, despite the passage of Proposition 64, several things will not change. For example, smoking or ingesting marijuana in public will remain unlawful, as well as smoking or ingesting marijuana in places where smoking tobacco is already prohibited. Similarly, driving under the influence of marijuana will remain illegal.
But what about smoking weed at work? When it comes to the workplace, California employers can take a deep breath of fresh air, because Proposition 64 maintains the status quo for employers seeking to maintain a drug- and alcohol-free workplace. In other words, employer policies related to drug possession, use and impairment as well as testing are not compromised with the legalization of marijuana use under Proposition 64.
Proposition 64 explicitly states that it is intended to "allow public and private employers to enact and enforce workplace policies pertaining to marijuana." The initiative also provides that it will not be construed or interpreted to amend, repeal, affect, restrict or pre-empt:
"The rights and obligations of public and private employers to maintain a drug and alcohol free workplace or require an employer to permit or accommodate the use, consumption, possession, transfer, display, transportation, sale or growth of marijuana in the workplace, or affect the ability of employers to have policies prohibiting the use of marijuana by employees and prospective employees, or prevent employers from complying with state or federal law (Section 11362.45 (f))."
Therefore, even with the passage of Proposition 64, employers may continue to prohibit use, possession and impairment at work and may continue to test for use when appropriate. Proposition 64 is not intended to interfere with these workplace policies or practices.
Employers should use this time to review existing policies and remind employees not only about the company's drug-free workplace policy and practices but also to specify that marijuana is also prohibited.

Year-End Tax Planning for Businesses

There are a number of end of year tax planning strategies that businesses can use to reduce their tax burden for 2016. Here are a few of them:
Deferring Income
Businesses using the cash method of accounting can defer income into 2017 by delaying end-of-year invoices so payment is not received until 2017. Businesses using the accrual method can defer income by postponing delivery of goods or services until January 2017.
Purchase New Business Equipment
Section 179 Expensing: Business should take advantage of Section 179 expensing this year for a couple of reasons. First, is that in 2016 businesses can elect to expense (deduct immediately) the entire cost of most new equipment up to a maximum of $500,000 for the first $2,010,000 million of property placed in service by December 31, 2016. Keep in mind that the Section 179 deduction cannot exceed net taxable business income. The deduction is phased out dollar for dollar on amounts exceeding the $2.01 million threshold and eliminated above amounts exceeding $2.5 million.
Bonus Depreciation
Businesses are able to depreciate 50 percent of the cost of equipment acquired and placed in service during 2015, 2016 and 2017. However, the bonus depreciation is reduced to 40 percent in 2018 and 30 percent in 2019.
Qualified property is defined as property that you placed in service during the tax year and used predominantly (more than 50 percent) in your trade or business. Property that is placed in service and then disposed of in that same tax year does not qualify, nor does property converted to personal use in the same tax year it is acquired.
Note: Many states have not matched these amounts and, therefore, state tax may not allow for the maximum federal deduction.....READ MORE |
