Michigan Supreme Court Denies Plaintiff’s Application for Leave in Favor of Condominium Association
|

CMDA Attorneys Joel Ashton and Stanley Okoli recently had dismissals upheld on two related Condominium Association cases in the Michigan Court of Appeals and Michigan Supreme Court.
To say the least, these were contentious cases in which a co-owner experienced a sewer back-up in her basement in October 2016, with the alleged subsequent discovery of rod hole leaks in the foundation, for which she initially sued the Condominium Association, its insurer, the plumbing/sewer cleaning service and the restoration company, but also eventually attempted to remove the assigned Washtenaw County Circuit Court Judge on alleged bias, attempted to disqualify the entire Washtenaw County bench by way of a Writ for Superintending Control to the Court of Appeals, sent a Quo Warranto Action Request to the Attorney General, later filed a second lawsuit against the individual board members of the Condominium Association and its general manager, and eventually appealed the dismissals of both cases.

The USPTO and FDA have Vowed to Help Generic Drug Manufacturers Enter the Marketplace

The patent system is designed as quid pro quo: inventors publicly explain how their inventions work, the government gives those inventors a limited monopoly, and then other manufacturers may compete. However, Big pharma has been abusing the patenting system in order to try to bully generic drug manufacturers from entering the marketplace after their monopoly expires, causing excessive drug costs even after the initial patent expires for a drug. Big pharma is approximately a $625 billion industry in the U.S. alone, accounting for 3.2% of the U.S. GDP. The average prescription drug costs big pharma up to 2 billion dollars to research and develop. It is no surprise that big pharma wants to maximize their investment. But there are proper ways to do this without abusing the patent system.
To understand how the patent system is being abused, one must understand a little about our patent system, its theory, and how we practically achieve this. In the U.S., a patent is valid for 20 years from when an inventor files for an invention. Michelle Richards Joins Livonia Office

Please join us in welcoming Michelle L. Richards to CMDA.An Of Counsel attorney in the Firm's Livonia office, Ms. Richards has more than 15 years experience in civil litigation, with special emphasis on appellate practice on behalf of municipalities, insurance companies, and corporate entities. Further, she has significant transactional and corporate practice experience. Prior to joining CMDA, Ms. Richards worked for a national telecommunication company as the Director of Regulatory Affairs for the Midwest Division. This position involved the handling of regulatory and corporate transactional matters, as well litigation management for franchise areas in 10 different states. She is currently a tenured law professor at the University of Detroit Mercy School of Law with emphasis in civil procedure, torts, legal writing, appellate advocacy, and public health law.
Ms. Richards obtained her Juris Doctor from the University of Detroit Mercy School of Law. She received her undergraduate degree in Social Science, Multidisciplinary Studies, with special emphasis on Political Science, Economics and Psychology, from Michigan State University.
