Public Comment on Proposed Rule Changes Until October 26th


The Supreme Court has opened a 45-day period for public comment on proposed amendments to the Rules of Practice and Procedure.


The proposed changes include:


  • Establishing timeframes for specific post-arrest events.


  • Broadening the scope of who can reopen an appeal due to ineffective counsel.


  • Time constraints for civil case depositions.



  • Clarification on which rules apply to custody, parenting time, and child support cases.

The ABA Releases Formal Opinion 508: The Ethics of Witness Preparation

Formal Opinion 508 discusses a lawyer’s role in preparing a witness to testify along with providing testimonial guidance. Under the Model Rules of Professional Conduct failing to adequately prepare a witness would be classified as an ethical violation.


With an increase of remote proceedings, the ABA found that brazen witness-coaching behaviors have been increasing, the occurrences were validated by the number of reported instances of misconduct.
