We’re proud to welcome U.S. Sen. Ed Markey as a featured guest speaker—one of the leading voices in Washington shaping the future of pharmacy policy. As Ranking Member of the Primary Health and Retirement Security Subcommittee on the Senate Health, Education, Labor and Pensions (HELP) Committee, Senator Markey is the highest-ranking Democrat overseeing key issues like commercial PBM reform and ERISA plans. He also serves as the top Democrat on the Senate Small Business and Entrepreneurship Committee, reinforcing his influence on policies impacting independent pharmacies and the communities they serve.
Sen. Ed Markey supported the PBM Reform Act of 2023, which advanced favorably through the full Senate HELP Committee under his stewardship. That bill included the following provisions, which are now law as part of the 2026 Consolidated Appropriations Act:

Rebate Pass-Through: It requires PBMs to pass 100% of all rebates, fees, and discounts received from drug manufacturers directly to the plan sponsor.

Compensation "Delinking": "delink" PBM compensation from a drug's list price.

Increased Transparency: PBMs are required to provide detailed annual reports to plan sponsors. These reports must include information on:
- Total net spending by the health plan
- Lists of drugs dispensed by pharmacies owned by the PBM
- Aggregate amounts of copayment assistance provided by manufacturers
Senator Markey has consistently supported government funding legislation with PBM reform policy riders over the past few years. The Senator has also supported efforts to ban PBMs from steering patients towards PBM-owned pharmacies and banning spread pricing and any willing provider provisions. We are excited to hear what Sen.
