About twenty-five years ago, “Robert” bought a property via land contract, a person-to-person agreement where the buyer makes regular payments to the seller without obtaining a mortgage. The purchase price of the house was $43,000.
After some years the seller passed away and a relative was appointed to manage the estate (we’ll call him “Joe”). Joe filed a Complaint for Possession after Land Contract Forfeiture, alleging that Robert had missed numerous payments over the years and owed over $38,000.
Robert applied to us for help, and we took his case. Robert was able to show receipts for most of the payments that were allegedly missing. In all, Robert had paid more than $104,000 over the course of the land contract: $43,000 covering the principal and the rest in interest.
We had an all-day trial. Other spurious claims were made… and refuted with evidence. At the end of the day, the court found no merit to Joe’s complaint and ruled that Robert had made all payments due under the land contract. What’s more, Joe was required to give Robert a title deed to the property. Robert was understandably delighted! Instead of losing the home, Robert and his wife can enjoy the home they love – and now own - in peace!
