Legalese Made Simple
I am frequently asked to explain in layman’s terms what legal terms mean. Here’s a fun little list of fancy words with a no-nonsense take:
Ore Tenus Motion
:
Asking the Court to do something out loud and in person at a hearing, no paper.
Conditions Precedent
:
The stuff you have to do before you can do what you want to do.
Notice of Intent to Lien
:
A letter that tells the owner you are going to file a lien if they don’t pay.
Notice of Intent to Foreclose
:
A letter that tells the owner you are going to sue them if they don’t pay.
Automatic Stay
:
A rule in bankruptcy that says you have to stop trying to get money for now.
Chapter 7
:
The type of bankruptcy where the owner just plain gives up – I can’t pay anything to anyone.
Chapter 13
:
The type of bankruptcy where the owner can pay some people but not everyone the whole amount and they need to pay over time.
Motion for Summary Judgment
:
A bunch of papers that tell the Court exactly what you want ($$) and why, and specifically asks them to give it to you.
Lis Pendens
:
A recorded piece of paper that is supposed to let the world know the property is involved in a law suit.

No other information for HOAs or Mobile Home Parks will be covered. This class will provide you the tools you need to become a successful board member.

This class focuses on the tools that HOA Board Members and Managers need to carry out their daily duties. This class is required by law for all new Board Members within ninety days of taking office. Once you have taken the course and have not gone off the board (for even a day), it is not necessary to retake this class, however, Clayton & McCulloh updates this class each year with fresh material.

New CEU Guidelines
For Community Association Managers

Did you know that the Regulatory Council of Community Association Managers changed the requirements for continuing education for licensed Community Association Managers? Effective, August 15, 2019, the number of hours required for license renewal is now 5 hours less than it used to be. The requirement used to be 20 hours. Now continuing education involves 15 hours of courses approved pursuant to Rule 61E14-4.003, F.A.C.
The first requirement is 3 hours of legal update seminars that include instruction in legislation, case law, and regulations impacting community association management. Licensees shall not be awarded continuing education credit for completing the same legal update seminar more than once, even if the seminars were taken during different years.
The next area of instruction includes 3 hours of insurance and financial management topics relating to community association management. Additional topics like the operation of the community association’s physical property also involve 3 hours of approved study.
Other required course study involves 3 hours of class or webinar time that focuses on human resources relating to community association management and features topics like disaster preparedness, employee relations, and communication skills for effectively dealing with residents and vendors.
To meet the new CEU guidelines 3 additional hours of instruction are also required that must cover any of the 3 areas of study described above or any approved course or courses directly related to the management or administration of community associations.
Only continuing education courses approved by the Council shall be valid for purposes of licensee renewal.
